iluvcks, do NOT let them scare you. If you can prove that you are, in fact, selling eggs/chicks they cannot touch you. The Michigan RTF Act supercedes any and all local ordinances...including zoning. If you are legitimately operating as a business, you do not have to obtain permission of any kind from zoning or any other local entity. We briefly had a run-in with zoning here in Salem Township. They were trying to limit the amount of animals we could have on our property. If you go to the Michigan Department of Agriculture's web page and do some searching, you can find some interesting cases to use as reference. My husband found a case similar to yours, in which a family with some chickens were being harrassed by their township. It went all the way to the Supreme Court. The ruling was for the family. The judge said the MRTFA clearly supercededs any local ordinances. He even said, as an example, that if a family wanted to start a chicken operation in the middle of downtown Detroit, they could do so...no matter what the local ordinances were. The ONLY stipulation is that you have to follow GAAMP (Generally Accepted Agricultural Management Practices). The only way your local officials can get to you is to petition to MDA to come out and investigate, claiming that you are not following GAAMP. They would have to prove that you are in some way mistreating the animals or the land. IF they were to do that, and if they cannot prove it, the township would have to reimburse you for any legal fees that you procure. The way the Act is written, you can even file suit for harrassment against your township.

All we had to do was send a copy of the MRTFA to our Township Supervisor, along with a copy of the law suit that I was telling you about. We politely educated him, and let him know that his Zoning official was harrassing us. We also let him know that his zoning official was putting the township in jeaordy of a harrassment lawsuit, and that we would be compensated for any and all legal fees if we had to go there. We haven't heard a word since. Read the MDA website in regard the RTFA. Call them and talk to someone about it. They will help you. What your township officials are doing to you right now is like a small town cop trying to investigate an FBI case. They are waaaaay off base, and they cannot touch you.

if anyone has any info, please share - we've been getting watery whites lately - not on all eggs, but some - the eggs are collected 4-5 x's/day - washed in cool water/dried and stored all by 7-8 p.m. at night - the girls are healthy, eat primarily pellets/some scratch/little bird seed here and there/free range/veggie/fruit scraps/free range....I've researched the cause, and honestly don't feel that the hens meet any of the criteria for the watery whites. Thanks!

I have a question for those attending Chickenstock. Would anyone be interested in tshirts? I just help design and order tshirts for our 4-H club and found it easy and fun, and thought it might be fun thing to do for chickenstock, but didn't know if others would feel the same way. If there is some interest, I have a couple of designs worked up, nothing fancy, just simple, but would be open to what everyone thought would go over best. This would be pre-order, pre-pay only, as there would be no way for me to know how many, sizes, etc I would need. Cost would probably be about $15, if I got enough interest. This company makes youth shirts, unisex (i.e. mens) and also carry women's t-shirts, so I could order if all of those. Feedback anyone?
 
Hi everyone! I too am from Michigan. We have gone through the laws here, and I can't find anything about owning chickens. Does anyone know the law for Grand Blanc? Am I a *gasp* criminal? LOL!

She took it all the way up the court chain and they ended up giving her a special land use permit the idiots, for a riding stable. Just to cover their butts as she was suing them.

I'm going through this right now also. I got permission from my county in 2002 to have the chickens in the first place. Have witnesses that include former police officer, former animal control officer, et. al. I am waiting for the county to issue me the final ticket and take me to court. I contacted the RTFA person in Lansing and that was a waste of time. I've let the prosecuting attorney know that I am willing to take it to the judge for a decision rather than depending on the locally elected officials who changed the rules. The more I have learned about the laws that are on the books here the more I can see huge holes in them involving every kind of animal from chickens to horses and many of those laws are in contradiction to the RTFA.
The prosecutor has had my case on his desk since April 16th. I made sure to drop by his office and let him know my side of it rather than him just getting the county version. I let him know that I was actually looking foreward to having a judge make the interpretation of the legeslative intent of the state vs the rules set by the county. As of right now I am still in this "chicken limbo" waiting to find out if they will take me to court or pretend I don't exist. This has been a long process and I am not nearly to the end.
We have been looking for a new house to buy because of this. When I find one I will rent this place out to the first person I can find who has kids with dirt bikes and a rock band at no cost. The one neighbor who complained about the noise will somehow come to wish I was back and I have let everyone else know what I am intending and who they can blame for it.

My middle son is here today and is going to help get things started on the new coop. DH is taking the day off work and we are planning on getting the pool up and working on the new coop. We are going to have a busy day here.

Boy sorry folks for having to fight for you chickens! Our township has a rule that a horse is considered a pet since it doesn't produce anything (but a lot of manure!), but all other 'farm' animals you need 40 acres. They had another rule that stated not needing 40 acres to have farm animals too. So our rental property got to keep the goats, due to the township contradicting itself. We went through the right to farm act, but the judge didn't use that as why the goats got to stay, just the township's lack of specific rules. This was a few years ago and we have since sold the rental house and no more neighborhood goats

Hey, Oopsy...

How many of those ducklings ended up hatching out for you? I had the weirdest thing happen this morning. Two of my Pekin/Cayuga X's had laid eggs in the 'nest' with the adult Pekin egg. I let them out last week, but I'm putting them in the sheep stall at night for safety. I've got one adult Pekin and the IR drake in there with them, because my neighbor across the street will be taking those two. The other adult ducks are kept separate. This morning, there were two little duck eggs next to the big one that the Pekin lays every day. I had no idea that was even possible! They're only 5 weeks old!
