Dept of Natural Resources (DNR) does the same function - have some serious teeth to them for sure.

If you take the water to the health dept and tests positive and they are otherwise good neighbors may see if they will make good. Possibly thier home owners insurance may provide some coverage. If they balk or not such great neighbors - then turn it over to DNR. Lot more stringent regulations and govt rigamarole will really run the remediation costs up. Leverage to get neighbors to play nice - cause you don't have to.

I phoned the neighbors and they will help me and they are very sorry, they want to buy me some new Muscovy's instead of cleaning up there mess HUH!!!! I disagree so they are gonna empty the pond and remove the clay around the edges and fill it up with dirt( is that effective?) and dig me a new one!

Test the pond water first with the health dept. If it's not contaminated, no need to replace the pond. Yes, they owe you ducks in any case.

If toxic there is going to need to be some run off rework done. Won't do any good if continues to run off poison into the new pond. Filling it in, reworking run off and creating another pond sounds like the best solution. Be careful run off is not bringing more of the same. If DNR gets involved there will be all sorts of red tape, testing, procedure...blah, blah, blah which will load costs TREMENDOUSLY. The only drawback would be if there are anymore problems from this pond area in future you would likely be on the hook and they would not.
Talk to the contractor, make sure they carry insurance, have references, experience, make sure you are involved and have approval/veto of anything. Tricky if they hire and pay the guy, he's working for them. Other way around....mehhh you gotta collect. Still, if both can be reasonable and resolve without OFFICIAL involvement, won't have a feud with a neighbor which can get ugly.
 
Another thought, not knowing how the land lays, but any where run off from thier poison got to the soil is going to have residue. Will leach down or might need removed and replaced. Dunno how much they used. Was it commercially applied by a professional?

so there shouldn't be any leakage into other ground besides the pond area it should be an easy fix exept for the runoff from the woods.
