Need Confirmation and Breed help.

I am pretty sure Tink is a roo, but would like others opinions. And if anybody has an idea of what breed he is, that would be very helpful. He came from Ideal in a Bantam assortment. Of course he is the kids favorite and we can not keep roos.

Looking at his comb I would guess rooster, but dont know the breed.
Hopefully for your sake someone will say I am wrong though!

Well looking at it now, the tail doesnt look that roosterish...

You might check Dallas' city ordinances. If you are truly in the city limits, I dont think they have a restriction on roosters, unless it becomes a noise nuisance and neighbors complain. I haven't read them in a while, but I know I can have them in Fort Worth.
 
Sorry, but he looks like a rooster to me. Since he's 12 weeks, I would just about bet that's what he is.

As far as breed, he may be a dutch bantam. Looks like a Mille Fleur cross to me (the speckling on the back is what's making me think so). Or just a black tailed buff Dutch. He could be a black tailed buff/red old english.

If you must find him a home, there are plenty of people on this site that live around your area that may be able to give him a good place to live. Just post an ad. But if I were you, I would try my best to keep him - he is gorgeous. I would definately check the laws and see if you really can't keep roosters. I wouldn't pay heed to neighbors squawking, if you know what I mean. ^_^

We have a no rooster rule at the house.
Not sure about the city ordinances.

I will post an ad later to try to rehome him.
