need tax help. Homebuyer credit

I saw this site http://www.federalhousingtaxcredit.com/faq2.php#1 And it doesn't describe my situation exactly in this scenerio:

Does a married couple qualify for any home buyer tax credit in the following situation? Spouse A has lived in and owned the same principal residence for at least five years. Spouse B has lived in and owned the same principal residence for less than five years.
In this situation, the couple does not qualify for any home buyer tax credit. Because the couple is married, the law tests the ownership history of both spouses. Spouse A clearly does not qualify for the $8,000 first-time home buyer tax credit, so neither does Spouse B.

Spouse A does appear to qualify for the $6,500 repeat buyer credit, but because Spouse B has not owned and lived in the same principal residence for at least five years, neither of them can claim the repeat home buyer tax credit.



I own my own home for 10 years. Hubby bought his first home in March 2009. We were married in 2008. He has lived with me for 5 years although he didn't change his address at work till a few years ago, so his w-2 kept going to his parents house. We now live in his house.

Can someone tell me, do we qualify for the $6500 credit?

AHH! I remember... I read a little about that some time ago... Didn't I read that if you applied for the credit after 2011, it would be considered a "loan" from the government, instead of a payment, and need to be repaid in the next tax year?
Well, at least my lack of knowledge might spurn someone else to asnwer!

I have asked questions with the IRS before and then they tell you weather you can get the credit that might be a good place to start. IRS 800-829-1040 Might want to try and set up a turbotax.com account and enter all your info and see if it gives you the home buyers credit based on what you have entered you don't have to file and can save and go back as much as you want to. I always recommend using the free edition it will tell you if you need a higher version.

If you find that you do qualify be prepared for a run around. I built a new home in 2009 which is the first home I ever owned. I have yet to receive my tax credit and I filed in February 2010. The IRS keeps coming back with more information they claim they need. All the documents they are requesting have been sent and sent again and sent a 3rd time. Everytime you need to resend documentation that say they need an additional 12 to 14 weeks to process. I'm not the only one running in to this. It seems to be wide spread. I hope you qualify and good luck!
 
Nope.
If you are married on or before December 31st you are married for the whole tax year. Filing status is Married filing joint.
One way(Maybe) around it is to file Married Filing Separate... I DO NOT recommend it! you get hosed on the deductions and will most likely end up PAYING!!!

Option three is to just call the IRS...They are more happy to answer questions rather than mess with correcting an erronious return! (but they are more than happy to give you a fine + interest!)
