Neighbor Chickens roosting in my coop at night?

If you opt to send a certified letter send a copy to yourself regular mail. Keep it sealed, what you need is the postmark.

I don't know what state you are in. That would help. In some states you are required to fence out any wandering livestock. In most other states you are required to share fencing repairs and costs. Fix the fence, toss the offending chickens back over, and file a complaint and send a bill if the chickens come back.

Sorry, just looked at your location. You might want to check Alabama state fence laws. You might have to fix the hole in the fence anyway.

Personally, I'd handle it a little different than these other suggestions.

You say you already know he is an ass. You will just make him into more of an (edit to remove swearing) if you send letters and threats.

I'd just fix the fence up really well and say nothing. Unless of course he comes back to complain. Then show him your video (I'm the one who suggested you take a video of them entering your coop by themselves) and say whatever you feel necessary, but I'd tell him he is lucky he is not being charged a boarding fee and he will recieve a veterinary bill if your birds get sick as his are the only birds who are sneaking into your facilities at night.

Ack, I'm totally guilty of this crime. I have a few 'wildish' hens, that have been jumping our 6 foot fence, crossing the road, and feeding with our neighbors chickens while they free range. Luckily for me, they dont mind, plus one of my hens lays them an egg every other day, or so. I tried locking them up for 2 weeks, clipping wings, but they really like it over there. I guess I'm just lucky, so far.

OP- next time they show up- catch em' cage em' and then do one of two things- call animal control to pick them up while youre at work, or put them in a box onto your neighbors driveway (mark the box and let him know theyre there) Personally, I would call animal control and just say 'I think they may be his but I think they have *insert infectious contagious disease here* and I dont want them around my flock.

You could always clip their wings and then send them back to him too, maybe that'll help keep them in his yard?

First, talk to your neighbor, and tell him he needs to keep his birds on his own property. Be nice about it, but be firm. If they still come onto your property, there are lots of good ideas here about how to handle it.
 
If he doesn't want them around your chickens and in your coop then he needs to keep them contained on his property. Period.
And put up a No Trespassing sign and inform him that if sets foot on your property uninvited again, you'll be pressing charges.
 
I'm a little unclear on the story. Have you talked to him and explained what happened? It doesn't seem like a big deal to me. Calling the sheriff was a bit of an overreaction but if I found my chickens in my neighbor's coop I would be a bit disgruntled, until I found out it was my fault.
