Sounds like this guy is a bit "off" and a slow learner.It is actually the state that charges for these things. Charges and restraining orders are in place. We are stunned it continues. I have never seen anything like it in all my life. I would just like a good nights sleep and so would my critters. Thanks so much for all the kind words and suggestions. Great ideas!
Many places have noise ordinances which he most likely would be violatingNeighbor harassment isn’t usually something that is illegal, at least not at a specific level. The laws do vary from place to place, of course, but most of the time even true problems between neighbors rarely rise to the level of being illegal. In most cases, the biggest legal question concerns actual damages. In order to have a strong or even a viable case, a party will usually have to prove, in court, that he or she has suffered some sort of definable economic or emotional damage. Monetary loss and property damage are some of the most obvious. On the emotional side of things, simply being annoyed or bothered isn’t usually enough — the harassment typically has to rise to the level of extreme distress, like anxiety or some other diagnosed mental health condition that has been confirmed by a medical expert.
Even if the harassment itself isn’t punishable, affected neighbors often have some legal remedies. Many local authorities and courts will issue no-contact orders and restraining orders that prohibit certain individuals from contacting or even coming close to named others. These take a lot less effort, and certainly cost a lot less, than going to trial or taking an issue to court; in many cases, they can end the problem, too.

Your neighbour may be a gronk of the highest order, however, dumb he is not.
Unless you get drs certificates stating the sound effects etc are giving you headaches and other stress symptoms, your neighbour is free to do as he likes. Going to bat for your chickens is admirable but the law doesn't care as the chickens can't speak for themselves. In the eyes of the law, your neighbor has not breeched any of the orders placed on him. Authorities hoped to scare him ... he called their bluff.
Getting them to act on these is also quite difficult, especially daytime noise. My local council has the power to act on the noise pollution laws that involve barking dogs. Do they act ? Nope. Not until three neighbours all got together and called police on the same night did the barking cease, some 13yrs later in my case. The other neighbours had also been calling police and council, but I was told each time I called that "no one else was reporting it." The noise is happening at 4am which is within quiet hours in most places with such laws. Thank you. It is a very bizarre situation! Facing criminal charges has actually caused the guy to escalate. I am finding out from law enforcement that this is very common. Who knew?I'm not a legal expert, but I'm pretty sure that playing gun shots and noise loud enough to wake the chickens from an adjacent property is probably loud enough to cause a noise disturbance on its own.
This whole ordeal seems kinda pointless and petty. Your neighbor has every right to not want to live next to chickens and/or a rooster, but sometimes in life you just don't get what you want.
This thread is bizarre.
We have filed and been granted multiple orders. If it were me that would get me to stop. It is very strange to me but the guy continues to escalate.Sue for the maximum damages the Court allows... AND file for a restraining/harassment order.
You may have to do that if this situation escalates. Disclaimer... I am not an attorney. Just trying to apply some common sense.
