Neighbors dog gone into my duck pen (update page 4)

Perhaps you can put a game cam up and catch him in the act next time. But, I really don't want to wish a "next time" for this at all!

ETA: You might want to start looking for legal advice about this because I know that dogs are not allowed to kill anything they want if it's not a person. You saw the bird in his mouth and did you say that you saw the birds in their yard? Do you have witnesses?

I can't see the being the case. What is it had killed your pet dog? Then I know in alabama it would have be taken from the owner and put down. We have a neighbors house (a few) that sit close to my waterfowl/turkey/quails,ect... one of them actually helped us work on the pen and enjoys it, another has a lab and understand that he is responsible for anything that his dog might to but also understands that if I catch the dog attacking any of my animals there is a shot gun waiting on him.. The other neighbor who is the closet.. Well she has these two annoying little dogs that come over all the time and jump on the chicken pen.. I have had words with her about it but she is just like oh well if they come over there...Needless to say though where all my waterfowl are there is an electirc fence around it.. you can get them that are solar powered now and put out a big punch. I would look into maybe putting one of those up.

As for the replacement cost.. I would look at it how much that neighbor means.. If they are understanding then they should pay wahtever the replacement cost of that age bird is.. I know with the ornamental waterfowl the older the birds normally the higher price and even higher if they are proven breeders. If it was me, I would be asking for the cost to replace that specific bird (which would include shipping or any travel cost).. If they are a butt about it... take them to the cleaners

All they have is to document the path the dog took and his escape holes. That way it has be document. Now you take that document to your neighbor and make him pay. He refuses you go to small claims court and collect your money there. You don't have to see the dog in action, all you need is show to animal control the tracks, feathers, blood, you name it. I think they just didn't want to deal with it because it only involved poultry.
 
Since the dog and the ducks were in their yard, they can say that the ducks came into their yard and the dog didn't come into ours even though there was a hole under the fence. I am getting legal advice, as my husband is an attorney.
 
Yeah that does not sound right. Livestock is very well protected legally (ugh I hate referring to my pets as livestock) but never the less, the dog is killing livestock. I would dig a little deeper, rather than just taking the word of an animal services person. They might just be too lazy, or feel underpaid to wade through paperwork and reports. I would doubt that's the case, but you never know. I just refuse to believe that a dog can escape (that in it's self probably broke at least a leash law) and kill someone's pet and/or livestock. I would shoot the dog and put one of your ducks in the neighbors backyard...tell animal control the duck did it. But joking aside (that's how I deal with heated situations...humor) I feel terrible about what happened, truly heart wrenching. I'm sorry for your losses. And I hope the neighbor does not even have to be ask to make the situation right, I hope they just offer and then follow through.
 
Just curious, what kind of dog is it?

Do they normally attack ducks?

I see a lot of posts here where people have cats and dogs living with their ducks and they seem fine with them.
