Nesting rooster?

I have two Rhode Island X chicks of about 13 weeks old. One of them has started making nests in the henhouse, so my (obvious?) conclusion was that this one is a hen, but a friend who has a lot of chickens thinks that this particular chick is a male (based on looks etc.) So... am I right or am I wrong?

I'd say it's a hen, I'm no expert by far but I'm used to seeing rhode island roosters with large combs and bigger waddles or w/e they're called.

I'm undecided on this one, can you take a closer photo of the bird standing on the ground? nesting behaviour may signify female but it doesn't look ready to lay yet, the comb is not red enough so not sure why it is nesting

Thanks for all the replies everyone! I am still not sure now whether I have a rooster or a hen. I always thought that roosters didn't nest...?

Anyway, here are a couple more photos, perhaps they will help?
The first one is a close up of the chick. Here she/he is 13 weeks old.



The second one is of the chick and its sibling. Here they are 12 weeks old. The chick in question is the one of the left, with the green eye.
