So yea that deposit would be extra money, that i would use to pay back.

I love this house,i mean yea it is a 2 famly old house but we would have our own section and he already said we build coops outside and use the garage for coop, incubator and baby chicks.
 
If he wont give you back the deposit and trust me he will find a way to keep hold of it, just deduct the amount of the deposit from the last months rent. hold it back and he cant do squat about it.

Make sure you have recipts of all work you did, materials you bought etc and deduct that from the last month/deposit also.
That way you technically get back your deposit and he still has the rent money.
 
I have had this issue in MA...If the deposit was placed as a security deposit and NOT as the last months rent if the tenant withholds any of the last months rent the landlord can take them to small claims court for the withheld balance of the last months rent as well as court fees and the landlord will win....If the tenant did repairs around the house and wants to claim them as improvements to the house and wants to be reimbursed even with reciepts the tenant will lose unless there is a written contract between the landlord and tenant saying they that was the agreement....if your landlord agrees to let you use the dposit as the last months rent then make sure you get it in writting.....It all stinks but that is how the court/law will rule in MA.

Just wanted everyone to know that I just received my monthly email from Griffenbrookltd in Candia where the chicken swap is going to be on the 13th and she is getting the word out in her newsletter so hopefully it will be a good swap.
Here is what she had to say in the newsletter:

"Love chickens? Love flea markets? What kind of question is that? We are hosting a chicken swap on September 13th. Bring some chickens, buy some chickens (or ducks, rabbits, whatever!) It’s a great place to add to your flock or schmooze with the fowl community (hee hee). Spaces are free, bring your own tailgate or table and we will offer the entire side yard to the swappers. It will begin at 11:00 am and go until the last one flies the coop(OK, I’ve got a million of them!) Come on down with the kids, they’ll love it! It’s like a fowl flea market!"
 
Well, we already decided to pass on this house becouse of his attudude.
BUT, Ok, the house in Townsend said that if we come up some money this weekend , they will take it toward security and then we will have till move in date which would be oct to have the rest.

Sooo i belive we will go for that one, he already knows about all the animals.
 
Having taken care of my dad rental properties in Mass. I can tell you first hand that what Hen Pen says is true. The law will allways side with the landlord and unless the tenants can show contracts that are signed by both parties, any improvements that the tenant did to the property using their own money will not get reimbursed to the tenant. Also, on the other hand, if the tenant abuses the property and ruins it, most times the landlord is poop out of kuck at getting any restitution for damages!

Yea , i am still looking on line too, becouse if i come acrooss the same deal but cheaper that would be great, i mean the rent at this house is $1100.00 a month we can do that.
