No Ordinance. Still told to get rid of them! MICH.

Yup, that's the paper alright. The chief came to my door tonight with a copy of the nothing ordinance, or more accurately a paper showing me what ordinance to go get in the morning. And saying the attorney sided with her. And that now it's in councils hands. And that the Michigan Right to Farm only applies to me if I'm commercial ( the first thing I did was send a letter of intent to the manager, so there should be no confusion there). ...and.....the chief and a state cop have been sitting in front of my house for an hour now, just sitting making a spectacle and giving my 5 kids something to keep looking out the window at.

I think this qualifies as harrassment. Under what reason do they have to conduct surveilance on you? Please becareful, this got out of hand in Georgia.

Im not trying to scare you but just to make sure you are aware. You should fight them, but be prepared for anything.

I know I posted this on another thread, but Chickens are sooo small town America. Pymouth Rocks? Jersey Giants? Rhode Island Reds? Kentucky Specks? the Ohio Buckeye? Amerucanas? Oh hey, throw in some freedom rangers in there too :) Be sure to tell that newspaper that the lowly chicken is a patriotic action and a nod to the self sufficency of our forefathers.

I would get the chickens back to your house ASAP as if they decide on no chickens it seems if they were there before it passed then you would be grandfathered in with old laws.
Where are you located at? I am starting to work with a few people to help be able to have them inEaton Co., Lansing, Mi but we are considered Delta township so have different laws.
Any advise would be great from anyone. Even the local Pet store is willing to help get a petition signed if that is what we need to do.
 
I think we're past the bring them back stage. I really think that what happened here was the chief jumped the gun and didn't know how to get out of it. I am definitely protected by MRTF. They should have just let this go and there wouldn't have gotten this far. I mean they had their attorney out to explain their own ordinance. My feeling is the chief could have received the complaint, checked the ordinance, said nope this is fine and let it go. I do think there is some support in council and a lot in the neighborhood, I am confident this can get straightened out I don't think anyone thought of this until the chief got involved. From what I hear plenty of people have had chickens and even roosters in the village. I'm just getting the feeling the chief is upset with me now, but I didn't start any of this, and I don't know what they think they're going to do now. I'm a law abiding citizen, never even had a traffic stop.
 
PERSONALLY....
I would start a "Journal" ( Diary ) of this process....and take photos of the Police Chief and "accomplices" and document everything I could (with as many witnesses as possible).
THEN .... I would SERIOUSLY consider filing a "harassment suit" against the parties responsible ( Police Chief, Planning Dept, etc. )

NOTE: I'm NOT the type to be "much-concerned" about how the neighbors OR community FEELS about MY ATTITUDE. THEY can "get-along" with ME if they choose - OR otherwise....It matters NOT to me ! WHAT DOES MATTER to me is the protection of MY Rights as an American Citizen according to the U.S. Constitution. I believe that MY ATTITUDE also benefits my neighbors...whether THEY understand THAT or not.

Hello Dear-Expectant Momma_ I am certain the Chief has royally messed up on this one. He has opened a can of worms now. Because Now everyone that has a flippin animal that is not "Chief Approved" is going to have to get rid of them. If not he is what I used to call at my job Singling you out!!! And you can raise some holy hell over that one. Just prey that he misses one animal in you community, and does not treat them the same way. This sounds like a road trip for me, to come your way and support you, and your live stock. You do need to get those chickens back on your property tho. And post a sign out in front of your home, Fresh eggs. And get a customer of course, you would then be providing a service for the community. I have so many people coming over to see my chickens, ducks, guniea, turkey, that it is hilarious. I have a radio in there back coup and play opera, christian, And Jazz music 27-7 a day, and they love it. I turn it off and look around like what the heck!!! You need to call CNN, and really shake things up. They would jump all over this!!!! The national attention this could recieve, could help so many people out, that are struggling with the same issue. Your family would be proud of you.

Two more suggestions. Put a video camera in your home pointed at your front door, and turn it on every time you open the door. Mount a dummy (or real if you can afford it) video camera outside pointed at your front door. That'll give 'em something to think about.

Next time the police or anyone is outside your house and it concerns you, call the police station (not 911) and say that you are concerned for your safety and want to make sure everything is safe for you and your young children. Keep track of everything that is going on and GET YOU CHICKENS BACK. That shows the city you are serious.
 
What she (Chief) dropped off was the ordinance:
"Principle uses permitted.
All uses of land listed as a special land use shall be permitted throughout the district under which they are listed. Any use not expressly listed as a principle use permitted is prohibited in that district unless approval has been obtained from the planning commission for the use as a use permitted after special approval.".




That is what I was warned about?! I also picked up the entire village code for district R-3 which has nothing in it. When I say that I mean nothing citing any of the above, nothing about land usage. Nothing about any type of animal, tree or... breathing space. It gives the list of use of R-3: Single Family Dwellings, Residential facilities, Churches, Schools, Cemetaries, ect...
but nothing specific at all reguarding single family dwellings. So with this, no one should be able to own a dog or canary or park a bike in their driveway or pretty much anything.
So this general code covers anything they want it to. And the attorney sided with them on this?

I pretty much copy and pasted off my FB page. This is as much of an update that I have right now. I am pretty much fumming mad right now.
There is a whole part about non-compliance with anything herein and 500 dollar fines and what not. No one at city hall will tell me anything, except to complain about the letter I emailed the manager last night. Everyone is mum, and I may just wait until the council meeting monday, seriously if they can just fix this then, then I'd rather go that route. I don't have time to screw around with court right now with the baby and all and this is really freakin' ridiculous already.
