she/he is smaller than our orpington girls that are also 5 weeks but she/he has quite the attitude and goes at it with our other rooster

The saddle feathers on his back. A hens saddle feathers are more rounded and a roo's are pointer. I would definately say rooster if he goes at it with your other rooster too.

Male specific saddle feathers do not come in until 12-16 weeks. At 5 weeks you cannot look at feather shape and come to any conclusion.

Pullets will spar as well. That is also not indicative of sex.

Orpingtons are a slow maturing breed. Right now there is nothing screaming cockerel though. Post updated photos in a couple weeks.
