Exactly. Our city AC can't catch a loose 3-legged blind puppy (ok I'm exaggerating a bit, but ya know....) so I assume the reason he's "accepted" is simply because they can't catch him.

If you put him in a pen, you essentially will sign his death sentance (because I HIGHLY doubt a roo would get adopted from animal control....seeing how most people are trying to give them away!!!!)

My in-laws neighbors lost a rooster once, it was in their front yard crowing every morning!!! I guess they got it back though, or else something else did, coz he was only out there for 3-4 days.
MY rooster escaped once too, but we walked the neighborhood looking for him. DH found him and I caught him several houses away, visiting "the cat lady" -- they came out in their PJ's to watch me catch him!! They said cars were stopping to take pictures of him with cell phones! LOL

That is one survivor of a rooster! He might not be a problem for you,just a little excitement for your ladies:cd The neighborhood has basically adopted General already, so you shouldn't have future problems with them if he(General W.) moves into your place.

Yes, he is quite the survivor. It was so funny the first day he came strutting down the sidewalk. We were amazed and dumbfounded at the sudden appearance of a rooster. I thought someone's 4H rooster had gotten loose. The second afternoon, he came down the sidewalk on the other side of the street. A cat stalked him up the neighbor's driveway and we heard lots of squawking. I yelled at the DH to go save the rooster. Before he could get out the gate and across the street, the General came walking back down the driveway with the cat slinking a ways behind him. He's whooped every cat in the neighborhood. He eventually settled down a couple of houses down and hangs in the yards around our 4-way stop. People who happen to be driving by and spot him stop and take pictures on their cell phones, stop and let him cross the road, and generally gawk. He makes everyone smile. Some folks have hung "chicken crossing" signs on their fences or trees. Although we cussed him every morning when he started crowing at 4:30, we worried all winter that he was going to freeze solid in that tree and fall off the branch. He's no worse for the wear and seems quite comfortable in his surroundings and has been featured in the civic association newsletter.
 
If it were me, I'd go to the powers that be in your town and offer to adopt him if they will promise to not make an issue out of it and send animal control to your house. I'd even ask for it in writing. Tell them that he will have a much better and surely a longer life if he is actually owned by someone than he will just walking the streets and fending for himself.
