She didn't ask for permission, I looked all over for it, and neither one of them have permission to use photo. So she needs to take it down.
 
I was able to download a picture from one of your auction on byc I deleted as soon as I did it. I don't know about your web-site I am not that great with computers but I bet there are people who can do it So sorry this has happened to you I don't think I will ever buy eggs off ebay. Hope you can get your picture removed.
 
I sent them a message too asking for a photo of THEIR actual eggs, not eggs belonging to someone else...I'll let you know if / when I hear something back.
 
I also contacted her and advised her that it would be best if she removed your photo. Your photos are downloadable from the auctions, but not your website. Hope she removes it!
 
Personally, I'm a little tired of having to deal with all the copywrites that limit how we can live and what we can do or make and sell. All the crochet/knitting patterns frequently have 'rights' attached to them now and you have to change the pattern 10% in order to make it your own so you can make and sell something from it.

But I do understand the passing the QUALITY being presented in a photo off as your OWN QUALITY of a product as being WRONG. So taking a champion photo of a chicken and saying your eggs will produce that bird WOULD BE SO WRONG! Sounds like this ebayer doesn't ever grow out their eggs into adults.......

I am SO GLAD that I have my own digicam and can produce my own photos!

Ebay does work to TAKE DOWN illegal/stolen stuff like that and addresses all complaints over a couple of days. It might be too late for this auction, though. You MIGHT be able to post a NEGATIVE COMMENT on the person's site as well.

Probably have to make your watermark darker and more obvious to help protect it.......and put a notice next to the photo about legal actions for using your photos without paying you for them.

Thanks to all who reported. This really hurts me. I also did a search for the city from which she claims to be and I saw a thread over on Nevada from some who reported her buying my eggs.... Well I now need to do a huge watermark - in Black colors on the eggs and list the city address for us as welll....Sigh...Why do people steal and cheat....That just gives me heartache and sadness and I imagine her hatching reputation is not the same as ours...You know her narrative doesn't match the eggs....What does she do -....cruise the net for photos??? Oh I need a good cry....

As I was reading your initial post, I was thinking that maybe the lady selling the eggs was just ignorant as to protocol about using other folks photos, and was using the picture as an "example" of the type of eggs she had to offer. Then I clicked on the link to the Ebay page where she boldly lies about the picture being taken by her! If she lies about this, then she could be lying about anything! Talk about throwing credibility out the window!

I hope you are able to get Ebay to do something about this. I really cannot stand people who lie.
