My apologies for picking him up, I'm used to the Summer where they usually die from dehydration under the same tree and its a bit horrifying. Thank you for the help! Really happy to see it work out!

From same area and can verify that it is in fact horrifying, if the weather doesn't get them it's usually the cats.
 
That's absolutely a circumstance where you put the baby back, if you know for a fact it's in danger. If it's not a fledgeling and you aren't sure that it's safe, putting it in a new nest certainly won't hurt.
