Unhatched deformed (chicken)chick help

I have two chicks that appear to have developed fully, but never hatched. when I opened their eggs I discovered why, their brains were not inside their head, one chick also had severe scissor beak. Three other checks from the same breeder have hatched and appear to be fine (hatched last night) (all in the same incubator, same age) (shipped eggs) (BCM)

Is it possible, that this could be Mareks disease??? And if so should I put down the other 3 chicks???

I am concerned that this could be some sort of contagious disease and I am worried about infecting my older chicks (one week old, and 5weeks old) from different breeders and my adult birds.

* Is this a valid concern, or is this is just a genetic defect and Im just overreacting?

Oh my... I'm really sorry that must be terrible to watch. I wouldn't put down the three chicks yet, but I'd never use that breeder ever again! Maybe just separate your three chicks from the others in a separate box.

I won't make that mistake a third time This is the second time I've use this breeder, the first time only one egg (out of 6) developed but never hatched, and now this
 
Don't know what that is, but it's not Marek's. Marek's is not vertically transmitted. It can't be in eggs (unless you maybe loaded a syringe with Marek's and jabbed it into the egg. Unlikely.)
Thank you for your reply, you made me feel so much better! I read that it can't be transferred through eggs online, but sometimes people have different ideas so it's nice to hear your thoughts

NPIP testing rules out the major diseases that can be vertically transmitted. If you want to make sure your eggs aren't diseased, order from an NPIP certified farm.
