Update - Debary Chicken Hearing

Just wondering if you pointed out this part of the code. To me this basically says that the zoning of debary, does not stop any zone from having chickens. Land Development Code Chapter 1. The purpose of the zoning was only for issuing permits.

Purpose. The purpose of this Code is to establish standards, procedures and minimum requirements for the issuance of all development orders and development permits as required by this Code and to regulate and control the platting and development of land within the City limits, except as otherwise specifically set forth herein; provided, however, it is not the purpose of this Code to regulate any bona fide agricultural production, including, but not limited to, horticulture, citrus, dairy, livestock, poultry, forestry or vegetables.
 
By the way on September 5th they are changing the codes:, please see below to see the definitions and what they will be changed to. Tell EVERYONE you can think of about these coming changes!!!!

Also, please note that City Council is in the process of adopting updates to the City’s Land Development Code that include clarification of the types of animals that may be kept in the R-4 zoning district. The updates include new defintions of pets, farm animls and livestock. Please see below for the proposed definitions. The update is scheduled for adoption by City Council on September 5th. The keeping of pets as an accessory use to single family residential is also being added to the listed permitted uses in the R-4 zoning district.

Farm Animal, animal raised for subsistence or profit or kept for use such as cattle, sheep, pigs, ducks, goats and poultry.

Livestock shall mean animals kept for sale, animals raised for food or other products or kept for use such as farm animals including meat and dairy cattle, pigs, ducks and chickens.

Pet, an animal that is kept by humans for companionship and enjoyment such as dogs, cats, fish, hamsters and birds but does not include horses, ponies, chickens, roosters, pigs or other livestock and farm animals.

Hi, Just found this thread, when I was trying to contact NIMBY who lives around the corner from me. I tought it would be rude to just walk up and knock. I'm shocked by DeBary's council, especially changing the guidelines after the fact. If there's anything I can do to help, I'd like to. My old hippy ways are coming out. I had researched the city rules several months ago looking to get a few chickens myself, and I didn't see any problem. Obviously there is. I'll keep following this thread. Thanks for everyone being so supportive. I can't wait until the next election. I wonder what Mr. Garcia's stance on this is.
 
We are having the same problem with this guy. The news stopped by his house, he did not want to talk to the media, but did say he did not think our child has autism. I should have seen him for the diagnosis before I seen some 20 doctors, would have saved me a lot of money. His neighbors did express their dislike for him, to the media. I am fighting the city as hard as I can for as long as I have to . Here are some links to some of the news outlets.

Hopefully this will be finished soon, but I will take it as far as I have to.
 
I don't have a clue how far you're willing to take this thing, but if I were in your shoes, I'd tell the minion that showed up on my property telling me all this stuff to show me the code/ordinance in writing, or get off my land. After a count of three, if he hadn't made a move to do one or the other, I'd start swinging. As to the jerk who said he didn't think your son has autism, if I knew my son had any kind of problem, and some cheeky neighbor piped off about it, I'd go see him, too.

The founding fathers would turn over in their graves if they could see what a complacent bunch of boot-lickers we've become. But then this didn't happen overnight. It's been a long, slow mostly unopposed process.

I have a hearing at City Hall in 2 days to plead my case in front of the commissioners.

I want all of you to pull out ANYTHING that someone might say about chickens that is negative so I can have a response ready. I want sources to back it up as well. I have several already but I need more - especially anything about rats, because for some reason the neighbor is convinced that my chickens made rats magically appear.

I am tired, just started a new job which makes me get up at 5am, and have about a billion things I need to do. I am calling on you guys for help, because a hundred heads are better than one exhausted one!

Thanks in advance, and I welcome discussion - especially if you have heard WEIRD things that people think about chickens. I don't want to have a single question that I am unprepared for. Do your worst... or best. :)

I wasn't going to post anymore on this website after I was rudely informed that I was posting my information that I have in the wrong form. But after reading your post I have copied and pasted my post and will share it here. I hope it will help. I have also sent a e-mail to the Autism Speaks and have asked them to help and possibly bring in someone from the Americans with Disabilities department in Washington DC. Not sure if that will help that little boy and his family, but it's work a try. Below is the e-mail I recived from the Mayor of DeBary and the e-mail addresses of all the Council Members. I also in my e-mail I sent a copy of the Pinellas County ordinance on keeping chickens. Below I have attached the link so you can download it and have it available. I would also get more of the news involved. Not just the local news (that was how I heard about this issue) but get on somewhere national. Good Morining America is very good about bring local news to the national forfront. UPDATE!!!!!!!!!!!

Here is an e-mail I received from the Mayor of DeBary and it looks like he is having an uphill battle with the Council. PLEASE start e-mailing the Council. Below is the e-mail and I have included the e-mail of all the Council mmembers. Come on all everyone if we all get together and start e-mailing this council and let them know how our chickens are not a threat to their city maybe they might listen. I have sent the mayor a copy of the Pinellas County ordinance here in Florida. If we all did that maybe they would draft one themselves.

Thank You for your Email. Words can not express what your support and understanding of the issue means to me. When a government refuses to even listen to the plea for help from a mother and child then that government no longer serves the people. This Council is heartless, and arrogant. Please check out the debary.org website Council meeting of Sep 5th, 2012 and you can clearly see that his Council did not wish to hear Mrs. Hart's request. They did not even want to hear from any others who support JJ. Mrs. Hart had to informed the Council that the others wanted to speak on this issue. It appears they had already made up their without hearing all the facts. Do you know why because they make the laws. Their actions proves one thing that children have NO VALUE. Please forgive me for this long Email but I am up set. If I had the power not one of them would still be a Council Member and I would request a special election to replace them. This Council serves only their own Agenda not the Peoples' Agenda. I am hoping and praying that at the next meeting which is Nov. 7th,2012. That a mass protest and out cry from the people in support of JJ show up. Someone or a group needs to stand up for JJ. This little boy needs our HELP so his voice can be heard. What a world we live in when a two year old has no value. For this Council to saying Our Children are our FUTURE appears to be just words. Their actions has proven that. Again Thank You. JJ and I need your help and support.
