What breed is this and what gender and what to do with Rooster

My wife bought some chickens about 4 months ago. Unfortunately she didn't get the breed. I'm curious what it is. She thinks it's an "Easter Egg Layer" but I believe there is a more correct name? Also, I'm posting a photo of two of them. And of just the one I suspect of being a rooster! My fear is that one of them is a rooster based on beautiful feathers and larger size. Can someone verify? It hasn't started with the "cock a doodle do" yet. What month does that start? I'm a city guy so completely ignorant :).

Finally, if it is a rooster, ideas on how to give it away/sell it would be welcome. I already floated the idea of eating it to the wife and kids and was met with "you monster", so need to come up with another solution. We are definitely NOT allowed to have roosters here (San Diego).

Easter Egger cockerel. There is a buy/sell/trade forum here, you can post him there and try to rehome him. The red one at the bottom of the second pic is a pullet. She looks like a Production Red to me.
 
Thank you all for your answers. I was hoping against hope that someone would say female or at least there might be some uncertainty as in the other question I posted. I guess I better start looking into giving him (her? :) ) away. At what age do they start their "cockle doodle do" business? That's probably when the city authorities will show up with handcuffs (human and chicken cuffs). I'm hoping to come up with a better solution than last time I had a rooster (Plymouth Barbed Rock). That time, I took it back to the shop where I got it. They said they could take it but not give money for it. Literally while I was in the store, a farmer came in looking for roosters and they sold it to him for $15 !. 5 minutes earlier and I would have given the farmer the bird.

The age of when a cockerel begins to crow can vary quite widely. To avoid issues, it may be better to try and re-home / sell him as soon as you can.

Agree that's an Easter egger cockerel.

I do most of my advertising on Craigslist. Stick to the Farm and Garden section and things go well for me. You can also advertise on FaceBook, fliers at the feed store, contacting local 4-H or FFA clubs, things like that.

That said, getting rid of roosters can be difficult. There aren't many forever homes for them. I've defaulted to eating them, myself, but I can appreciate the situation you're in. You can't eat pets

You might find someone to pay a few dollars for him, or you may count yourself lucky to be able to give him away for free.
