What breed is this?

I recently bought 12 chicks from a local lady. She represented them as a particular breed....when I first saw them I thought "naaaa", but then I saw her birds and saw the (only) rooster she had, so I thought they HAD to be what I wanted.

You tell me what you think this guy is and then once I get some responses I'll reveal what they were "supposed" to be. There is NO WAY IMO that this bird is what she represented it to be.

I have since emailed and texted her to say I understand there could have been a mix up (ie another hens eggs laid in the nest), but I need to return these chicks and get my money back so I can get some birds that I can use in my breeding programs.

They were represented as a bantam breed (I'll tell which later).........
 
black skin, 5 toes, crest..... I say silkie cross, looks like a mix to me....
 
Sparse leg feathering's usualy indicate mixed breed's.I Free ranged a lot of my bird's in past and got many different mixes.I never tried to pawn a chick off on someone that I said was pure if they were hatched in free range season but most of my bird's came out nice looking anyway and they alway's sold.But if you paying an extra amount for pure that's what you should get.
 
5 toes, light feathering on the leg....
silkie cross or faverolles cross ?

There are not 5 toes, but there is black skin.........the other chicks in this hatch do not have the little starting of a top knot, this particular chick did.....
 
hmmm, right foot looks like there are two toes there towards the back
