WOW....now this feels CREEPY!!!!

In many states, you can buy guns from anyone, they don't have to be a licensed dealer. You can buy guns at gun shows and pawn shops and from your Uncle Larry. You can be given a gun as a present. Each state has their own restrictions. California and New York are the worst that I know of. Texas and Montana are the best. (You rock, guys!)

In Texas you can buy handguns in the classified ads or anywhere else. I think the gun laws do vary from state to state. The guns have to be "legal" meaning no sawed off shot-guns, etc. For fully automatic (machine guns) you need a federal permit.

We also have a new "gun carry" law (2007):
"The new law seemed pretty straight forward. If the gun is legal, you're not a crook, you're driving your own car, and if the gun is stowed (i.e., you're not driving around with it laying on the passenger seat like an idiot), then you can carry a gun in your car when you're driving. At least, that's what legislators thought they'd passed."

Well, if the ad had stated he wanted to trade for a rifle I wouldn't have thought any more about it. At least as far as I know, that is legal (though I really am not all that familiar with laws on rifles). However, I know that is illegal. So, redneck or not, one should have issue with it. If the laws are more lax in another state, that's fine. Here, in order to buy a handgun you HAVE to have a background check. There are people who don't like it. Problem is, whether they like it or not, it is the law. That was my point. He doesn't live in Texas or any other state. He lives in Arkansas.

epends on your state. Personal gun sales are completely legal in Colorado, and there is nothing wrong with them. In fact, in most states I know of, personal gun sales are legal. Just because he doesnt want to get one at a gun shop doesnt mean he cant. There are many reasons for wanting to do a personal sale, in cluding price, conveniance, (no waiting period) etc.

And you are not required to take a background check or sign papers for personal sales.

But I agree it sounds VERY fishy in this case.
