I would definitely ask the hay guy to pay the vet bill and replace the hay or refund your money. He should also be the one responsible for removing the contaminated hay from your barn. That is just part of the cost of doing business. He didn't maintain his hay fields properly and sold you a contaminated product. His negligence in not maintaining his fields and not recognizing that there was a high concentration weeds in in his hay caused you severe damage. I sure he didnidn't have any problem taking your money. He should pay the damages and consider it a busness expense. If you walked into a feed store and bought a bag of purina that contaminated and poisoned your horse, Purina would be expected to pay. Last year when all of those pets were poisoned with contaminated pet food, the manufacturers had to pay. If you ate at a restaurant that fed you spoiled food, they would be sued. The hay supplier was negligent. We buy hay, and we cut hay on our property. We know what weeds are and are not in my pasture. We spray accordingly. Hay is expensive right now. For the prices charged, you should expect some quality control from the supplier.

I'm so glad to hear that they are doing better. I know this has been a very hard time for you but it has been a learning experience for all.

This guy admitted he knew this weed was in his hay. He is on the noxious weed board in the neighboring county in Idaho, but he says he didn't know it was toxic........ whatever.

I would definitely send him the bill and demand replacement hay or a refund.​
 
Picked up my horse, he is happy to be home. All the swelling is gone. Now he needs new shoes as the vet removed them.

He came home and promptly rolled in the dirt and jumped around and tooted at me.....

I was so glad to read that you got to bring your boy home..
I bet you laugh to tears to watch him roll in his lot at home. I know that just $ 1,000 would be a small amount compared to what it very well could have been. But I would request that the supplier pay it... That would be the least he could do.
Again I am soo glad all is going so much better.
