There is a reason that there aren't very many swap/trade days left in Texas. In order to sell birds off of your property you must have a license from the Texas Animal Health Commission. Depending on the number of birds you have in a calender year these permits cost $25-$500. This deters a lot people from selling at an organized trade day.

This is a shame because trade days were a lot of fun and we would go to them all the time. In the 80's we use to have the Elgin Trade Days in the Elgin park and we made the local poultry club a lot of money and friends.

well thanks for the info....even though it sux. Well maybe we can organise a meet and greet with an informal "swap" involved?
 
That type of swap seems like it might not be ok with a buisness...they could get fined or something for hosting such an event, couldn't they?

Are we still legally able to sell individual birds to individuals without a permit from home? Are eggs included in this need for a permit?

Just wondering...in case say, a neighbor wanted to buy a few birds.

Where could we look up that law?

i would approach your tsc manager and see what he says. that's what i did with my feed store. people that buy more livestock whether it be horses or chickens, need feed and supplies for those livestock and it's good business for tsc. it is alot of legwork to make sure everyone knows about it, making sure the paperwork is there and you're in compliance with the law, but it's not that hard if you enjoy chickens.

all chickens need to be tested and you can get free testing from texas veterinary medical diagnostic laboratory. their number is 979.845.4186.

then if you want to sell your chickens off premises, you need to turn in a certificate of registration with the texas animal health department and pay a year fee depending on how many beaks you have at home. http://www.tahc.state.tx.us/animal_health/04-07_Poultry_Fowl_Registration.pdf

In Texas, there is WAAAAY less government hand in private operations than anywhere else I've lived (don't een THINK about Germany or massachusetts if you dont like big govt)

In Texas, it isn't registering your birds so much as registering YOU as a seller of birds on your property (ies) to be able to sell birds. For tracking purposes. You don't even have to give them a 100% count, or say how many you sell, or what kinds you have, none of that.

If you look at the form, it has you give your name, your address(es) where the birds are located, and approximately how many living things with feathers you have when you have the most on your property at one time.

That's it. No vaccination requirements, no tagging, nothing. Just registers YOU as a seller of birds. exotic or domestic. just stuff that is living and that grows feathers.

Which is still ridiculous. But WAAAAY less ridiculous than registering each bird or whatever. And a lot cheaper than selling a few birds to a neighbor and having them get the word out and then getting a fine from Texas for illegal sales.

well the way i see it is like them askin me to register my guns. If they know what you own its eazy to take or worse TAX! I understand the need for healthy birds, and I agree. If theres no med check or vaccines, why register? Whats the reason? (or purpose) If a person stops you on the street and asks whats in your purse or wallet would you tell? Just my .02

Ya know...that makes sense. I guess I am VERY institutionalized. I was in the Army for awhile, and my hubby currently is, so we are used to the gov't being into EVERYTHING, including our dadgum luggage when we're moving!!

Don't get me wrong, I don't like it. I think the buyer should bewatre more than the gov't beware. The gov't was created for very few things...roads, free trade, trading with other nations, and defense of the homeland.

NOT for making sure the folk down the road didn't buy a bad product. and NOT for enabling idiots to roam the shops of the world crying about whats not fair when they do no research before they buy something and end up with a bad deal.

grrrr. why do we pay politicians who want to turn us into gov't dependant fools? I don't honestly remember why its so great to depend on them for everything.

So, we give these guys a salary to make laws that make us give more to the govt and why?

Why would they want to register sellers....and make us pay them part of our hard earned cash from bird sales, when they have nothing else to do with the entire process, or guarantees or anything? What do they give us in return for these fees, other than the possibility of more fees?

SOOOO, if you only need it to sell chickens somewhere not your own property, I suppose it is still legal to sell on your own place without registering and ADVERTISE about your place anywhere else without registering, right?
