Any Actual Wording Banning Backyard Chickens in Ormond Beach, Florida?

Okay..this is a really old post that I am writing on and hoping someone sees it and can give me a heads up on where things stood for Citrus Man. I too am in Ormond Beach and going to my HOA board about the 3 little hens and 1 sweet roo that have been at my house for 6 months and ask for an exception. The neighbors love them. They are "free range" but never leave the yard. I have had them for 6.5 months there and never an issue until about 20 days ago when given notice they had to go. I have the city stuff...county level would ask for a fee and permit them and no Roo but we are city...HOA pres told a neighbor it is illegal to have them per FL state law but I can't find such a thing and would also make Key West and Ybor City felons...lol Just checking if anyone had any other "ammo" I can use to sway in my feathered friends favor to stay..."Bird Sanctuary" is a fall back..and "Fowl" would also include ducks, geese, grouse, pheasant...all the wild things we love...

Sounds like your issue is with the HOA regardless of what your city, county or state codes are. And it sounds like the HOA president just gave a false answer to avoid the issue (I doubt there's a state ban on chickens as there's a lot of FL members here).

What you need to do is get a copy of your HOA bylaws and look to see if there is anything about poultry in there. Generally HOA rules trump everything else, so regardless if your city, county, state allow them, if HOA rules say no, by living in that community you've agreed to their bylaws.

Are there any lawyers, law makers, word wizards, etc;, out there that can look at Section 5 of the Ormond Beach codes and see if there is anything actually not allowing backyard chickens? I've looked and the closest I see is "livestock", but in the code nowhere does it say poultry, fowl, chicken, hen, rooster, etc.
