Backing out after paying a deposit?

Most cases the suit is more expensive than the deposit. Offer a discount or a partial refund, if he refuses and sues without a contract I hardly think he has a chance. Your word against his, what would hurt you is if the date you gave him was a firm date or just a estimate of time.

I'm a builder and have been involved in construction for approaching 50 years. Too many times I have been burnt by people backing out after the work was completed. I would not refund the money. I'm sitting on two hand carved mantles that I took a minimal deposit, on barely covered materials, and I wouldn't refund their deposit. If in the future I am able to sell them I will return their deposits.

That's what I did- we had so many power outages with the storms we got behind. I offered to take money off. Plus I have sooooo many emails- if he takes me to court they'll probably think he's psychotic.

Well, depending on just how much money is involved, he probably could only get you for the deposit amount. And if it isn't high dollar, he might have to take you to small claims court so he can do it without the expense of an attorney. If he does, he can't get much more than the deposit, and maybe a small fee for trouble. I think I would wait it out. If you offered him a discount via email, print it all out and make a file. You are being reasonable, he is not. Did he pay paypal? If he did doesn't he have to go through that arbitration?

Why are you using this blah, blah, blah, stuff? Tell the true story for pete's sake.

Did someone pay you to hatch eggs for them? Then after the eggs were hatched they decided they didn't want the chicks? You supplied the eggs?
How much were the eggs "really" worth? How much was the agreed upon price for the entire thing, eggs, incubation and chicks? If you sold the chicks would the amount equal the agreed upon price? Can you afford to give back the deposit? Do you just not want to? (I'm not saying your a terrible person if you don't want to.)

Tell them the truth. A. I don't feel I should have to give back the deposit after all the work I put in and now I have to dispose of these chicks.
B. The agreement was for me to supply the eggs and hatch them for you. You can either pay the entire agreed upon amount and take the chicks and sell them or forfeit your deposit.

IF, this person is a relative, give back the deposit. Keeping the peace in the family is worth more than the deposit. No the principal of the thing does not apply.
IF, this person is a friend and you don't value the friendship, keep the deposit and say goodbye forever.
IF this person is a friend and you value the friendship give the deposit back.
IF you can afford to keep the chicks and give back the deposit, do so.
IF the person has a good reason for not taking the chicks, ex. lost job, is sick, is an idiot

, give the deposit back.
IF it won't create a hardship for you to keep the chicks, give the deposit back.

Maybe you should read the whole thread before you post...she has said what it's about.

I believe he is a millionaire- or close to it. Seem as he wants to sue the heck out of me (to put it nicely) and doesn't care what it costs. All over a couple hundred bucks. He says he'll press charges for theft if I sell the stuff to cover his bill. Does that make any sense?

I don't understand why he doesn't just take the stuff! We gave him a hell of a deal- he can turn around and sell it for double in no time.
