It carries itself like a cockerel but I've had curious pullets stand like that too.
 
It looks like a black Australorp to me as well.

It is possible it is a clean legged marans. Most do have feathered legs though.

That being said I strongly agree that feed stores often have chicks in wrong bins and most do not know what they are.

Depending on current age it could be male.

That comb will start growing in the next 3 weeks if it is a boy.
