Marty sadly not all states and locales have good laws to protect livestock. Even when they do, not everyone is aware of them, and then when an officer turns in strays not all shelter workers are aware the dogs are to be held. If there wasnt an active criminal case they may have had no option but to release the dogs. Time to contact your local lawyer to help get through this.
 
Ok, between last post and now, while getting kids from two different schools, I've gleaned info.

1. In Emporia, if the dog doesn't bite a person, they can't hold it, no matter how high the damage. No viscious dog.
2. The police officer that has the case is gone today and tomarrow, so it took them a while to get info
3. Tomarrow, I have to go to police office and get copy of the paperwork, which will include dog owners name on it
4. Lawyer advised me to go get my birds out of the trash can, bag them, and keep in deep freeze, in case we need to
prove that the birds died of dog attack (even w/pics and 3 other witnesses, aside from the two cops) as opposed to
heart attack, etc. (That'll be gross) Oh, and the first load of trash went out Monday, with most of my Khaki Campbells
and a few anconas in it. I've only got like 6 more with a few anconas and geese and the big turkey left to freeze, once I take
them out of the trash can.

5. He's pleased I've asked Celtic for value allready, especially since I've gotten birds from her, and she's got stock from
my original (now defunct of course) breeder. Says thats a good source for values for obviously equal birds.
6. Have appt with lawyer 2 pm on Monday, to immediatly decide how to go about the case. He's thinking a demand letter
maybe, or small claims, or one other claim I don't remember.

7. I'm calmer now, but terrified for my birds, even with all the fence work DH made us do on Sunday. Everyone is getting locked down in cages or the barn at night, and when we leave, no exceptions, except the turkeys that can fly.

Oh, and out on the lawn, where I put them to bake after their swims (which totally freak out baby girl these days) Lucky was happily nipping at weeds, and digging through grass munch on what bugs were withen her reach. Both girls still sit with their legs mostly out behind them. What is this about??? Lucky appears to be trying to stand, but she spreads her wings, and puts her beak in the dirt, then stands and falls fast. At least she's trying. Baby girls will drag herself around just a bit, and I think I saw her take one bite of grass.

This is just like 1 nightmare after another Marty. I am shocked that the dogs were released to their owners, if they come around again I hope you'll be ready. Sounds like your going to have to be the ones to make sure they never come again.
 
Wow! That's not how things work where I live. Dogs attacking livestock carry big penalties here. What about talking to local prosecutor to make sure formal felony charges filed, then restitution sought through criminal? It would be a bummer for you to spend $$$ on a civil lawyer if the criminal system will work for you for free in your area.

Thats a good idea. They are lined up to be charged with Viscious Animal, Animal at Large, and No Tags. I think he also mentioned felony again...... I will call tomarrow and ask the city prosecutor (or county, however that works) to inquire.

So, I'm a little p.o.'d here.

Apparently the dog owneres did come and claim their dogs, and the dogs were released to them. Yes, released. I was like what?? why??!! The police office is supposed to be getting me the names. I was told they wouldnt be released, but they are home, wherever that is.

I'm gonna be locking up birds every day and night, even though I have ample fencing.

Baby girl does not have as much white foam over the continually troublesome eye. Lucky is just hanging out. Both are in the sun right now, but I'm about to move them back inside the locked doors, instead of behind a little 3' fence in my barn door.
