Can I fight the power company?

The EMI coming off those power lines (EMI=Electromagnetic Induction) is enough in my opinion that the health risks are'nt worth it. I agree with the other poster that said make them buy you out and then move someplace safe.
 
Pray. I am a Believer and God has moved mightily in circumstances that seem impassible and impossible when we cried out to Him. Find out what rights you do and do not have. Then, take action. If they're wanting to pay you....that may indicate that they don't have the right of way. I'd not allow or have that on my property. We searched for 2 yrs for a place to rent/land lease that didn't either have huge electrical towers or cell phone towers on or too close to the property while still meeting our other needs.

The dangers of the EMF's warrent a fight! I'm praying for you!
 
Every property that has electrical power has some sort of easement that allows the power to come into your home, and frequently, although not always--it just depends on exactly how the power lines are routed--to access adjoining neighbors.

Unless the easement is specifically for high voltage lines, then I doubt that they can force you to allow it to cross your property. As was mentioned earlier, the fact that they are offering you $$$ to allow it, it sounds like it is not required. Look at your deed and legal description of your property; find out exactly what easements are in place. Then you will better be able to fight for your rights.
 
Doubt that you have enough money to take them on......they will argue that your "reasons" aren't valid. It's amazing what they can get away with. As for the eminent domain, they would have to pay you what it's worth------however that amount usually isn't what you would think it would be. Happened to my family. Not much you can do about it, except try to sell before it happens. Bummer

Find the easement first off. Is it filed with the county clerk and recorders office? Take it to your county attorney and get their idea of what it can mean and your options.

Now if the pole is just a temporary thing and is not going to be there for long there is not much you can do about it except to ask them to put on the side and not in the middle of the driveway.

I know easements are a pain in the rear.
 
I work for a telephone company so I know a little something about utility easements. If there is an easement, the utility has the right to access existing equipment and install new equipment in the easement. The landowner has to provide reasonable access and cannot build a fence or outbuilding in the easement without knowing they may have to move it in the future if the utility needs access. A lot of the time the utility will pay to have the fence removed and replaced, but this is not universal.

A cable cannot cross a property in the air outside of the easement (such as diagonally across the corner of your property. That is called a vertical trespass). If they are providing electricity, phone or cable by crossing your yard from the pole to the neighbor's house, they are probably breaking the law. Check your local laws to be sure.

They can't put a pole in your drive (not to mention, a few feet ether way wouldn't make a difference to them usually). I'm assuming this easement is on the road edge of your property and your driveway is the main access to your property.

The are required to put the surrounding area back into its original condition when they are done if it has been disturbed by their construction.

One thing to keep in mind (and I know a lot of people won't like this) is ... every utility (power, phone, cable tv, etc) has to get to your property somehow. It is usually through an easement on someone else's property. If you want the conveniences of the modern world, you will also need to sacrifice a little.

and one last bit... I have those huge transmission towers crossing my farm and if anyone knows how to make an induction coil that works to grab the power that just flows through the air, let me know. I've been trying to figure that out for a few years. I figure, if I'm not touching the lines then I'm not stealing. I'm only taking the power the are leaking onto my property.
