can we use the creek and dig a pond?

I live in hte west where water rights are right up next to horse theft and cattle rustling as hanging offenses (or at least they all used to be). BUT, people still get VERY, VERY upset at the idea of diverting water from its natural flow. There was a huge, decades long court fight over property rights of the Colorado River. Now I realize that the srteam you are referring to is not at all in the same league, but the concepts are the same. Best to do a LOT of background research before even thinking of digging that first shovelful.
