Can you create and/or patent a new chicken breed? How????

Yes you can develop and patent a new species of any animal or life form so long as it is genetically unique and can be replicated by natural or Un natural means. Such as glow fish, they are unique because they had a jellyfish gene spliced into their DNA but are infertile. So in a legally speaking manner yes. As for having such breed recognized by a group like the APA you must have the 5 generations by 5 breeders for 5 years and submit all the paperwork and breed development forms and so on.



Glofish are not at all infertile. I know people that have bred them by the hundred in their tanks. If they were infertile there would be no need to patent them, the patent is to protect the market and ensure that the "right" people get a cut of every one sold.


Yeah, there was lots of myth, hear say and assumptions they were infertile but that was proven false long ago...

The licensing agreement states "Intentional breeding and/or any sale, barter, or trade, of any offspring of GloFish fluorescent ornamental fish is strictly prohibited." and thus they could sue anyone that violates that licensing...

One has to remember that IP rights are only as good as the amount of money you want to spend defending them, in many cases it's not worth the money to defend them as you will likley never recoup your legal cost since it's likely if you win the person/company you sued will simply file bankruptcy or not pay the judgement and you have to factor that into your projected profits... A sad reality that Asia has exploited and has built a huge national economy upon willfully violating IPs with very little prosecution...

I've been interested in this very subject for a while now and after several different combinations I've found one i like and want to go forward with. I call it a mayhoubin. It's from a cross between a black breasted red malay and a silver spangled appenzelar spitzhiuben.

The hen is black with white lacing and looks very gamey.

I hatched this little guy a few months ago, but he died due to cold weather. This is Frisky, a silver duckwing phoenix + D'uccle mix.

She just started laying but trying to create a beutiful, big brown eggs, meaty carcass and broody.
