Chocolate Birds in the US?

how bad of black does a bird have to be to be considered chocolate? There was a bad black jersey giant roo for sale a while back. I kept trying to see him in a different light, but he always looked not quite black to me. like burnt black.

There are also glossy genes which can affect the way they look.
 
Chocolate can be very dark up to off black.
This is probably due to melanizers.
If you cross a chocolate suspect roo to a non black chicken the melanizers should be reduced and the chocolate tint would become more brown (lighter).

But chocolate chickdown should be easily recognized. They get darker with age.
