Does this seem like a coincidence? Possible stolen picture...

When I looked up pictures of seabright roosters, I saw many that looked similar to yours and the drawing. For all we know, the artist owns some of the same breed from the same hatchery. You could talk to a copyright lawyer, but in my opinion, there is nothing indicating that they copied or did anything to your photo. It is possible that they may have used your photo as a reference, but did not copy it. There's nothing in particular that I can see that says that is definitely your chicken, so I don't think much can be done.
 
They have it in both Silver and Gold. Frankly, I find that hard to believe.

How do you know they used a picture at all? Maybe they saw some sebrights in real life at someones farm. Also I don't know what you could do about it since i people pay money for that drawing it is for the drawing not the picture of your chicken. People buy pictures of building and drawings of buildings. If someone buys a drawing of the same building as someone has a picture of the person who takes the picture can not "sue" the artist.

I agree with you, but wanted to say that copyright also includes protection from derivative works. Many artists have been sued for just using a portion of a copyright photo, even famous and established artists. But, they have to prove that the artist definitely copied that photo and it has to be recognizable as being that photo (or part of), to a reasonable person.
 
If it is drawn from your picture without your permission why dont you ask them to take it down from their website and maybe you could then work out an arrangement for them to pay you something for using it if you want to let it be used... I think it would be wrong for them to use your picture without getting your okay first .
 
Do you know when this artwork was originally drawn? How old is your rooster?

Your rooster and the drawing have several differences, but some things just look like what they are. If I took a picture of a daisy and some one drew a similar picture of a daisy, so that mean they stole my photo or does it mean that is pretty much what daisys look like? I am pretty sure I have seen photos of daisys from every angle and with a variety of backgrounds, some might be mine, some might be very similar because the plant is the same.

Chickens are much like that, unless you have some chicken than no one else has ever seen, they look a lot a like. This is kind of why they are bred to look like a certain kind of chicken, those traits get passed on. Things like spurs that are different and combs that are different are good hints that it is not your photo.

Sorry, but if you are worried that your one of a kind rooster photo might be copied, make sure your register your photo so you can win damages.
 
Let me make it clear that I am fully aware that the comb and spurs are different. I knew that before I made this thread and regardless I still think that is my bird. I still have this rooster to this very day. He is about 3 1/2 years old. I got him with my first shipment of chicks Sept. 04, 2008. (Yes, I remember the date I got them). He is about a year old in the picture. The design from the website was made May 1, 2010. Why I am just now finding this picture, I do not know as it has never come up in my searches before. I have looked through the Google pictures myself and I simply DO NOT see any other picture that looks like it. No, I am not being biased because I want to convince you. I do, however, know my birds and the breed. If you want to get technical, there technically is no other rooster like him. Yes, he may have the same color and pattern as every other Sebright, he may have a rose comb like them too, but no bird has that same body type or the exact form to this comb.
 
holy cow! those look like exact matches! I think they stole your picture, however, unfortunately there isn't really anything you can do about it because they eddited it, so it is technicaly no longer your photo
