Dog

I for one think that if someone loved and cared form their dog(s) they would not let them roam free. That does not mean tie it to a tree!! My dog is a very friendly, sweet shepherd husky mix. He would not harm a flea. My dog has half an acre of fence in yard to stay in. He does not leave that yard without a leash. I know that he would not hurt a person, but dogs will be dogs and he could easily hurt someone's small animals. Not to mention getting hit by cars!!!

It has been my experience that people that have nasty, vicious and rude dogs are usually nasty, vicious and rude themselves. Lawyers poke fun at those that take dog bite cases, but I feel there is nothing that gets someone's attention like a good civil judgement. Document the dog's ownership. Is it licensed? Often, the owner will simply remove the collar and license and deny responsibility. Get witnesses and take photographs.

Unfortunately, many owners of mean dogs want their animals that way. They keep vicious, unsocialized dogs to protect their drug stashes. These types settle fast because they do not want any attention focused upon their activities.

In California you can shot most animals killing you livestock, chickens encluded. The owner is the blame and you can't shot him. This is one time an electric fence would work. Because of the size if the dog don't use the wire that comes with the kit. Use barb wire and run two strands. It took my nieghbor's dog only one time of of charging the fence to learn that area is off limits. I orginally put the fence up the keep the bear out but it works for dogs too.

The following site, run by the University of Mich. Law School has most of the state's (and some local) animal laws posted.

http://www.animallaw.info/policy/poanimallawindex.htm

Find out if your county has nuisance animal ordinance/check your state statute.

In Missouri, one may only shoot dogs that are attacking Ratite birds (emus, ostrich), but only damages may be collected for Non Ratites (poor chooks). However, if the dog is a threat to a human the dog may be retired from the target pool (and I will always find myself between the chooks and the dog - so that's that).

One may also pursue other legal means of recompense/threat: Tell the guy you're going to sue him for depriving you of the right to use and enjoy your property - I've found this to be almost as effective as actually shooting the neighbor's dogs. Of course, none of our living neighbors are that close, and the folks who occupy the church graveyard next door are the most brilliant of neighbors who have never failed to mind their business.

I don't know who owns the dogs that bothered my flock, the nearest offending houses are more than a half mile away. I just put a notice in the newspaper
"Loose dogs injuring free range chickens on private property will be shot per livestock code chapter 77-1-2. Area Bypass, Dickson, Wayne’s and Highway 90, tell your neighbors." I am hoping it may cause a few people to think twice, they may have thought their medium sized pets are no harm to anyone.

Web links to law libraries and such are nice, but they are also notoriously inacurate.

Go to your local library, and go into the reference section. They will invariably have the state and county law books right there for you to examine.

It's *very* usefull to know and understand your laws.

Actually, your best bet is to call your County Commissioner/Sheriff, and be very specific about your concerns/situation. Memorialize (write down what was said) conversations and stash them. A few minutes of effort in the present will often be most useful if things get ugly.

Well my hen is doing ok, she is in pain and doesnt like the wrap thatwas put on her. And I think things will calm down now. The vet went over to talk to the owner of the dog, and the guy didnt even know where the dog was Agian!!!! Well the vet then called the sheriff and the animal control. And They went out here and found the dog about a mile away and chasing sheep. It didnthurt any of them (luckly) and they confescated the dog and putcharges against the owner. They took pictures of my bird, the other poor half eat mutt, the spots in the fence where the dog pushed through the wire. I geuss last week some body else had this dog at their place and it ran their quater horse through a fence. So with all of this I imagine they are either going to put the dog down, or at the very least not return it to the same order. I and the rest of the nieghbor hood will probably have to go to court and testify about what had happend. I am keeping my fingers crossed that it will go good and this guy will pay for all the H*#@ he has created.
