Duck pond draining onto neighbors land

I have a friend who owns chickens, ducks, geese, and a turkey or two. He keeps them in a fenced-in area containing a small man-made pond which has a drain. The drain flows into an underground pipe which exits at the edge of his property. When he cleans out the pond, all the silt and whatever else the birds have left in the pond flows out the pipe and onto his neighbor's grass.

Is this something he should be concerned about in terms of ordinances? We're in semi-rural Virginia, if that matters, and zoning allows him to keep birds on his land.
 
we have the same problem only it ran onto the road instead. i would try and stop putting it into the neighbours garden. i would try to extend the pipe so it goes into a drain. that's what we did anyway. Hope this helps.

It isn't much different than if he cleaned his yard from chicken manure or dog poop by tossing it over the fence into his neighbor's yard. Yes, I would consider it a problem, and a possible health code violation. It may also be a zoning violation. About the only way it might be okay is if the neighbor wanted it as "fertilizer."
 
Check your zoning regs and you will find that you are responsible for effluent from your property.
