Fences dont always make good neighbors... Pics at 11

Why would she even WANT to walk through someones yard like that, ..even if she can..
I would feel funny about doing that.. its pretty tacky...
I would just make my own path around my property to get to the pond...

tell them to take the long way around about the pond! I would not have them walking across my pond when they can take the long way and get to the same place. It is to dangerous and you can be sued! No doubt.
I have some people fish on my little canal to the lake and walk across my yard, but they sometimes have to, and I don't let anyones kids but mine go down there. To dangerous people are sue happy these days.

Exactly Katy, the easement is the 50 ft Swath. In the photos, you can see that it is my driveway up until you get to the barn then it just sort of continues on out past our barn and past the pond to that gate. It is on center so 25ft to either side. They are following the easement but just before they get to the pond, they take a right and walk through my yard along the wall of the pond to 'their' end of the pond.

They arent the only ones who use the actual easement, there are other property owners even farther south from where her land ends who come in maybe 4 or 5 times a year. I dont have a problem with the easement, its the wandering through my yard, using my picnic table, letting the kids run around that close the bank of the pond that stresses me out.

The dog issue makes me nervous but eh... what do you do?...I always fly out the door the minute one of my dogs barks so I have never had to worry about them other than the time that I let them out not knowing that they were out there fishing and Isa almost knocked the one in the pond with her big tail...

So, I just try to be vigilant. But we all know that if something happens, I am in big trouble

I agree. I saw you have a fence, or they do. Why don't you put HUGE I mean HUGE beware of the dog signs there where she comes in, and by your side of the pond, and a big snarling rotweiler, on a chain that leads right to the entrance! Oh and no trespassing signs in front of the beware of the dog. Oh then you can add "trespassers will be shot" just for fun.
Or is that to passive aggresive?

Yes, sorry....you and Katy potsed while I was typing. Honestly, I am confused now as to why they have an easement at all. Of course, if you agreed to it when you bought your house, there is not a lot you can do about it. Easements are recorded as encumbrances on the title to a property. Basically, they are a "condition" of you owning the property and run with the property when sold. I am confused though as to why it was even necessary to begin with as it looks like they can simply enter from the other side. Easements are generally used only when they are necessary for the people to access their property.

Again though, if you agreed to it when you bought your property, there is not a lot you can do about it now. It is absolutely essential that you get out your title and/or title insurance and read exactly what it says. How far is it from the road across your property to where their property starts on the other side? Usually, when I have seen easements here they haven't said anything about the distance off the access road. That makes me think maybe they said 50' so that they could access the pond. I wouldn't be surprised if full access to the pond is even mentioned. Anyway, no reason to guess though, just find your paperwork and see what it says.

I'd find out EXACTLY what it says, and put up an electric fence preventing them from going anywhere BUT where is described on the title. Fences work both ways ya know.

Yes. I'm "passive agressive" like that.

Oh, Lord. That would drive me nuts. I truly feel for you. So, they are all basically using your yard. I would put a fence up along the road so that they can't do that. You're right- that is opening you up to all sorts of liability. I don't know how you could tolerate all that. You are obviously much more patient than me. Is there no way at all you could even do like a short wire fences with some sort of latching gate?

Well....the evil side of me says that I should buy a cattle gate like the one that they have ( You can see it in one of the pics I posted) and install it right where my property begins on the north side so everytime they want to use the easement, they have to unlock the gate, come through and relock the gate behind them. If I was rich, I would buy 10 of them and put them every 20 feet... mua haa haaa.

Of course, if I were rich I would sell and move next to a BYCer! lol

Heck if I were rich, I would give it away and move next to a BYCer. Maybe we need a BYC commune or something? lol

I agree that you need to check to see what the exact wording is. Any chance that the jog they take at the pond is contained in the 25' on that side of the easement?

This is exactly what I would do. Seems like most of the problems are due to the pond. If the electric fence doesn't work, a few dump truck loads of fill will do the job nicely. I would fill my part of the pond in all the way to the property line. Then they will have no reason to be on your property at all. Not worth the headaches.
