are they (HENS/eggs) free range if they are in a 1/3 acre fenced run ??

You could call them "cage free."
Free range doesn't mean much here.. They use "pastured" to define hens that get to graze on grass and dig for bugs.
All eggs sold in CA have to be at least cage free.
