Stallings
We have been battling Our town of Stallings, NC since October 2008 we still have our hens but they have to go by June 15th, I was wondering if it's possible to get a court ordered emergency injunction due to medical necesity to prevent the removal of our hens.
( We are vegetarins and do not believe in cruelty to animals, we will not consume products linked to factory farming ( grocery store eggs ) due to the conditions which laying hens are kept. I however have 3 growing sons and the our eggs are a MAJOR part of their diet. - One of my sons was born Human Growth Hormone Deficient and needs everything he can to help him grow ( he is almost 11 and weighs 52lbs) I feel that taking away this food source could affect his health. I have a doctor who can confirm this.
Has this ever been tried this, or am I pushing the envelope a bit to much? Suggestions?

I also say go for it! We're raising our 8 year old grandson who has a genetic condition and it also revolves around what kinds of food and drink he can consume.

We have gotten specific food and drink implimented at his schools and done tons of research on what to do for his rights. If you have a doctor and/or a nutritionist on board (we have both), then fight as hard as you can.

I wish you lots of luck!

If you have doctors and nutritionist on board like someone else mentioned, that can't hurt.

My Husbands afraid that if I keep pushing, they ( town officials ) will make our lives miserable - I'm not so sure - I think its my legal right to see that the officials look fairly upon this issue instead of basing desicions upon myths and personal opinions. We have been before the council 2xs now asking them to rethink their desicion but not luck. Do I have another option besides an emergency injunction? Do you think a Judge would even hear it?

How do your neighbors feel?

If you could get ALL your neighbors that abut your land to sing a petition saying the chickens are not a problem you may be able to get them to look again. The more signatures the better. These guys get voted in and sometimes a majority opinion will change their minds.

We have a petition with almost 200 signatures - all local - We also have over 125 letters directed To town hall in support of our hens - the mayor has been to my house to see the hens and discuss things - I've had realators and people knowledgable in avian diseases speak at town hall - the hens and my children have been in the paper 2xs and on local news 3xs - We have presented the town with binders full of info & letters. Yet they dont want to listen
I'm not so sure they have even reviewed the information !

Well, an injunction is not a legal solution or recourse in and of itself; an injunction is just an order by a court and it can be used for various purposes. Here is a good defintion of what an injucntion does. And You may not need an injunction anyway, even if you lost the case you should still be able to appeal, and while you case is under appeal the decision of the trial ocurt is on hold unitl the appeal is decided.
