Heads Up If A Neighbor Free-Ranges Chickens On Your Property

Oh, I so hate this kind of thing... The legal stealing of someone elses land and property! ARGH!
But the best advice is always to get a lawyer who knows your local laws to take a look at your title and give you some advice ...or even two different ones, never hurts to get a second opinion.
 
I know of two in my experience, one involved access to the property in behind of our condo by the owner of that property - he could use our driveway to bet to the back of his property, and the other involved a pathway to a public beach in Maine that ran through private property. Both of those instances involved land use for access, not the use of someones elses land to feed free ranging chickens which is a totaly different thing.

So yes - speak to an attorney. Land use is a well settled area of law and you should be able to get an answer pretty quickly.
 
When we moved into our home I mentioned putting a fence up to the neighbors. The next summer I had a boundary survey done.The summer after that I had markers put in every 10 feet.Then a few months later the fence went up.No more trespassing. I do not care what was done before I moved in between the neighbors like the underground rain gutter that now floods my yard.I will change and/or remove anything I am legally allowed to do on my land.I know that is not very neighborly,but you have to do what is best for you and your homested. I refuse to ask for permission. I refuse to tolerate on my land anything that neighbors may have done before I moved in.Like kids cutting across the yard,or picking fruits and flowers.My yard now.

Unless there is something in writing that is LEGAL and came when you signed for the home...then I would do a survey and let the neighbor know the birds need to go home.No way would I want a neighbor chillin' in my yard! Who pays the taxes on that land? What was done before was BEFORE.As some say...there's a new sheriff in town!

Either way the neighbor will be a pain if he is kept off your property.The nerve of some people.Yes,some people let this sort of thing go on,because they just don't want to deal with the fighting that will result.My mom was/is like this with neighbors.Hopefully no one will claim her land under adverse possesion.

The solution to this problem is quite easy. GET A LAWYER. If you have a dog then you need to have a fenced in yard for everyones sake. The Dog , you and your neighbor and his chickens. Any easements should have been revealed "before" you bought the property. So this involves not only you and your neighbor but the seller and the realestate agent who sold you this property. Now if you have a dog and it attacks his chickens then I guess he better keep them home, easement or not, but that's just my OP. A lawyer can set both of you straight.
 
FENCE... If you stop the birds ,no more reason for neighbor .You can,t hurt the birds so use mean thoughts on neighbor

Funny, like most bullies, he's since backed down physically and verbally, according to my friend. No more free-ranging chickens, no more intrusions by the jerk. (Her hope is that the chickens have been re-homed to a nicer owner.)

Darn it, had a brain fart here but isn't there a thing where if there are ANY issues involving a property... taxes, old murders, EASEMENTS... that you have to come clean about them totally BEFORE selling or else you're in big trouble?

If this guy has gone and gotten a paper traceable lean basically on this property then it should have been mentioned when they were looking at the house.

AH... DISCLOSURE... that's it. Does Cali have laws about disclosure? I've heard of cases where something wasn't talked about and then found after the fact and the seller and/or realtor who lied (and yes, omitting info in a disclosure state is lying) were responsible... some have to buy back the house, some just have to pay fines, etc.

I'd definitely look up the laws there and see what can be done.

Also, just because one owner didn't fight this guy (maybe they tried and that's why the jerk went to court to get this right to trespass and there was nothing the owner could do about it?) doesn't mean that YOU have. The property has changed hands... what if you wanted to put a fence up? Would you have to ask this jerk for permission to do something on your own property... totally bogus. Fight Fight Fight! This guy is a cheat... wants to steal other people's property rather than buying more for himself.
