Help- Port Charlotte Florida

Run an ad, target the more rural areas inland, surely someone has a place and will take him, especially if he's a good roo and gets on well with kids

last time I checked, according to the 4-h club in town, it is only legal to have them if you are part of a club and plan to raise them to sell at the fair. I'd like to do a story on this. My husband and I have 2- chickens and 1- rooster in Port Charlotte Florida. We had a visit today for Code Enforcement stating they received a complaint today about our chickens and we are not allowed to keep them. In everything I have read ( Charlotte County Ordinances ) we can have them, we do not live in a deed restricted community, we have them on our fenced in back yard in a nice coop my husband and son built. We take good care of them. If anyone knows how we can fight this- please help. Our two year old loves his chickens and would be devasted to lose them. Thank you for your time!
Any update??? Did you have to get rid of your chickens???
 
It is also my understanding that up to 3 hens (not roosters) are permitted in residential areas in Pt. Charlotte. Further, they must be contained (no open-range privileges) and provided an adequate pen, coop, food and water. They must be humanely treated. I sell my eggs to pay for their food! Again, no roosters allowed. If a neighbor files a nuisance complaint, you may have to lose your hens. In that case, please notify me.
 
So after some serious research and contacting different agencies including code enforcement and the County attorney. It comes down to this. Since raising of poultry is specifically mentioned in AG zoning and never mentioned in any other zoning it is NOT ALLOWED. here is the problem with this.. this is a example and the county laws are set up this way. If in one zoning it specifically say you cannot park on your property in any un-paved area but yet that rule is not mentioned in any other zoning. The county considers that as it is against the code in all areas. Its not right and they get a way it. I have asked a local attorney and it is confirmed that if you live in any place that is not designated as Agricultural or AG then it is not allowed to raise live stock or poultry.

With that said I think its about time for people to get together and fight this one.
 
Just curious...Last year we picked up some chicks from someone in Port Charlotte... these chicks were in baby swimming pools inside the house, but outside she had a TON of chickens roaming around. One of the Facebook groups I belong to had someone else in Port Charlotte selling chicks right before Easter and now they are selling eggs, so they obviously have hens. So how are people like this getting away with having them? I thought I had been told that you were allowed three hens in Port Charlotte (like others here mentioned) but now you are saying this is incorrect?
 
Yes, as What I have been informed in writing by the county is that if you do not live in AG or AGE zoning then raising of poultry is "dis-allowed" or "Not-Allowed" The Code enforcement MGR says that the way the laws are written if it is specifically mentioned in one zone and not in any other than it is only allowed in the one that it is specifically mentioned.

Now my self and a few others on here totally disagree with them, I have asked the county attorney to interpret the code and his response and still awaiting a response. The last I heard they do not want to do that for me but I am still pressing the issue and still going to get my chickens whether they like it or not until they can show me in writing where its NOT-Allowed
