boy thats nuts! around here the owner of the cow is responsible, if its loose and you hit it you can sue the owner, and they get fined.

I would say $40 to replace the hen but how do you place a monetary value on your emotional strain of loosing a beloved pet?

Do you really think your neighbor would pay the $136? And if not, is it worth your time to sue him/her for it? If not, then maybe a more "reasonable" figure would be best.

I agree with the suggested $40 figure. Someone who doesn't have chickens wouldn't understand the emotional aspect of it...they just wouldn't. Let us know what you decide to do for sure. I'm curious to see if he's truly sincere about paying for your chicken or just saying it in hopes you don't call animal services on him...

Compensation for a hen, I really don't think "emotional" value is going to fly. Frankly I think if the owner of the hen is even slightly unreasonable with the value, he will end up with nothing.$25 to $50 is about as far as that bird is going to fly.
 
I would say replacement value, which would include vaccination and cost of shipping. If you sold the eggs, then you could ask for lost income. And any other damage the dog might have done.
 
I would say that $40 and a written guarantee that the dog would be securely contained and euthanized at the owner's expense if it runs loose again. If the owner will not sign such an agreement, then you should charge more. BTW if you haven't filed a report with the authorities yet, please do so. If the idiot has been cited twice previously, he really is very irresponsible with his dog and must not care about the small fines. However, the more times he repeats the offence, the larger the fines (at least that's how it is in most places). Don't make it easy for him.
