HOA won't allow chickens

Just got shot down my the HOA president. Seems neighbors in our summer resort community who all live more than 150 yards away and maybe spend a month here total objected to my 8 pullets in a chicken tractor. The closest neighbors were all contacted beforehand and they were all alright with it. 'If you had them then others would do it to.' Since there are maybe 10 permanent residences in a subdivision of 140+ half acre lots. and only one within a city block full time cannot see the big deal. Just hope the market for vacation homes improves so I can get the heck out of Dodge. (If you kept them in the garage that would be OK.)" Not very any bugs or grass on the concrete floor in there. lol Next house will not be in a HOA!!! To change the CC&R's requires a 100% vote from the homeowners-fat chance from at least 8 of them.
That's ridiculous. I would love to have neighbors with chickens. Especially if they were just pullets. Also, I don't chickens would thrive in a garage. Sorry for your misfortune.
 
So sorry for your outcome with the HOA. Sounds like there will be a 'for sale' sign going up soon on your place...best wishes and again so very sorry!!
I would love to get 10 or 20 acres and have all the chickens I want. It's probably worth it!

No its not..That is why some people buy homes in HOA's.....Too change CC&R's in any HOA is like congress trying to override a presidential veto...it isn't going to happen...People love the HOA's until they want to do something that is forbidden...then they want help changing the CC&R's which isn't going to happen...They are stuck with house which no longer suits there needs or lifestyle..Only option, comply or move. This happens allot and there is no winning it..The owner has a contractual obligation unlike a person in a "city" <--- hint....
 
Sounds like we don't have freedom anymore just allowed to do somethin as long as we pay for it!

In a HOA the person signed an agreement so they have no say in the matter...State, cities, counties, etc outside HOA's...is a different matter. The problem with most are they are trying to work within the system instead of challenging it.... and when they do challenge it, they are not prepared so they lose...If you are prepared, there is a chance of winning..no guarantee, but a good chance...

Playing by the bureaucrats rules is generally a losing proposition. Using the technicalities of the law gives you a better chance at winning. Understanding a cause of action and the 3 elements of a cause of action is important. Understanding jurisdiction and how it works is equally important. Understanding what is a "fact" or what is "evidence" is important. It is not something you want to learn under the gun (i.e. pending court date)..Entering legal land is like entering the rabbit hole...You never really win because your time and effort does have worth but you can throw a wrench in the system.
 
I despise HOA rules with a passion, and feel for anyone that is stuck living under them...

Right now I living in the perfect location to laugh at HOA rules, I live on a 30 acre unincorporated farm, no local, town or city rules to follow, and we are zoned residential estate, basically the same as being zoned agriculture they just tax buildings differently depending on use and I can't have an airstrip :) But, right across the street is an incorporated gated retirement community that of course has a HOA, as well as city ordinances they have to follow... Lets just say they don't exactly appreciate some of the things I'm able to do and have even called the po-po many a time to no avail as I'm not breaking any laws even if they don't like what I'm doing across the street... I have started to actually call the police department in advance to let them know when I'm doing something like going out for some target practice, unfortunately it doesn't help much because their policy is to follow up on all reports of gun fire, so they come out anyway for the obligatory wellness check, but at least calling ahead they don't show up with sirens and lights anymore... Even had the gate guard call the fire department on me for a burn barrel last month, the fire departments (two departments respond do to my location) and the po-po showed up (as they must for a 911 report of a fire) shaking their heads for the gate guard wasting their time and resources... They told me they had a talk with him, so maybe he got a clue...
