Honesty in advertising??

What the OP asked was whether he has a case for Fraud in a court of law - and that is a matter for a Legal Council to determine. Personally, I don't know what the law says about verbal contracts or email contracts in regards to hatching eggs.

as for Buyer Beware, I personally feel that it covers just about everything you can purchase.

In our "lawsuit happy" society, maybe all the buyer needs to do is talk to the seller - then figure out if there is a cause to take further action and involve lawyers and courts.

Well, I know breeders, us included, that do outcrosses to improve our birds......we don't advertise it but we are honest when asked about it. We do not integrate the outcrosses into our flock until they are the final product we are looking for.....we do the steps using F1, F2 and so on birds.....even if we are into the 6th generation of our cross some of the characteristics can and do pop up now and then, but I guess we are doing something right because I have to say that the BLRW are my favorite birds on the farm at this time.
We do have some BCs but we only have them for eating eggs at the moment but I do know that a large group of breeders went to the Illinois show to get the BCs accepted into the APA and they were rejected because breeders are trying to follow their own "standard"......meaning that most of the birds had different looks to them......as for the crossing, might have happened and it might not have happened. You do have to cross breeds at some point to make a new variety.

about the eggs being shipped this way or that way.....hmmm, If you worked one day in the postal service you would laugh at that statement about packing the eggs standing up.

I probably wasn't expressing myself propelry, and I'm the first to admit that I have no tact. It just seemed as it others were telling OP "you got screwed, whatever." I'm just tired of dishonesty, either through lies or ommissions, and having the results fall under Buyer Beware. I sure hope he works with the seller to fix his situation.
 
The BCM eggs I bought didn't exactly turn out like the pictures of the parent stock either. I do get nice dark eggs from them so I guess I can just tell everyone that I breed for egg color. LOL

That is an outrageous and ABSURD statement!!!............................. You have NO way of backing up that statement and many many MANY people would disagree with you on that STRONGLY!

It is apparent from this very lengthy posting that you have "issues" with several breeders you are dealing with.. and buying many many eggs from many many people............... I received a VERY lengthy email from you last year inquiring about buying Marans and in that email you discredited at least 3-4 very respected breeders of Marans even though you admittedly were fairly new to the breed..... I was put off by your condemnation of others and did not respond to your email............. With all due respect, you really need to take your concerns directly to the people you are having issues with before you "rant" on a public forum..... I am not a fan of "rants" at all for that matter..... They should be handled privately between the parties involved......

FrenchCopper, as I understand, you are relatively new to marans. I, too, wanted only the best when I started but you cannot expect absolute perfection. The best you can do is research and talk with folks who have lots of experience dealing with marans... which you did and still weren't happy with them. The marans breed, from what I understand, is far from perfect at this point here in the US. Health, type and egg color problems are of big concern and are trying to get worked out by reputable breeders. The very best you can do is purchase from them and work on these issues yourself.

Buyer Beware is an excellent comment. Ask for pictures of the flock, ask plenty of questions and even references if you are spending that much on eggs!!
