Honey, why can't you....

In my house both the seat and lid are kept down at all times, except when in use. This way everybody has to open and close something ~ equal work for each. It also keeps the dogs and cats from playing in the water and keeps foreign objects from falling in.

It is also much safer if you have small children in the house (I don't). They put that lid on there for a reason!

best "cure" for the toilet seat up syndrome I've ever heard was in Judge Judy's book. Aparently her new husband was hard to train in this area as well. So after another night of getting up in the dark and "falling in", she grabbed a couple of pots and went into the bedroom and standing right next to him starting banging the pots together. Of course he bolted upright a quite startled look on his face. She calmly told him "that's what it feels like when I hit cold water every night!" She reports that it solved the problem nicely!

We put BOTH seats down ALL the time. Not only does it solve the who leaves what up or down problem, but your bathroom will remain CLEANER. Yep, when you flush an open toilet, it sends a slight water vapor/mist out ... It really does make a difference. Enough reason to do it.
