How to reconcile "organic" requirements with high hawk traffic

I'm informed by my state ag agent that new regs are coming which could require that I free range my hens. I am in the middle of a coop construction project and planned on an outdoor pen but it looks like that might not be enough to get me an organic label for my eggs.

My problem is that this area is prone to a lot of hawks.

Any ideas on how I can reconcile government regulations that seem to expose my flock to being eaten by raptors? Or is this just more typical government ignorance at work?

You'd have to cut 'N paste your state's verbiage from the regs, so we can understand better.
Don't know what KY says, but "Access" to pasture is typically stated.
