HR 875 - Could this could affect your production of Eggs and Meat??

spook listed the best site to go to. It's come up about 5 times so far. conradpdz has a good explanation. There is a lot of fear mongering going on about it. It is a lot of reading and hard to understand for most people. As conrad points out you have to read the exemptions.

I appreciate the lengthy explanations given however, I find no concrete evidence of the intent of this bill to over look us "little guys". In fact I find the exact opposite.

The bill in it's current form is vague. The language does not specifically exempt any small farmer, backyard grower, "organic" farmer, or anyone else.

The only true exemptions are :

a. "(B) EXCLUSIONS- For the purposes of registration, the term ‘food establishment’ does not include a food production facility as defined in paragraph (14), restaurant, other retail food establishment, nonprofit food establishment in which food is prepared for or served directly to the consumer, or fishing vessel (other than a fishing vessel engaged in processing, as that term is defined in section 123.3 of title 21, Code of Federal Regulations)."

b. And the mention in several sections of "those regulated under Federal Meat Inspection Act and Poultry Products Inspection Act."


Here's the problem folks. We, as small poultry producers, are exempt from the PPIA (yup, I read that one too). However this new bill specifically says - REPEATEDLY - that the new bill covers the regulation of those NOT regulated by the PPIA. Therefore, HR 875 is purposefully designed to regulate US. This is NOT "fear mongering", it is what is written in black and white.

Further, it was mentioned that small farmers, backyard growers are exempt because of this statement :"nonprofit food establishment in which food is prepared for or served directly to the consumer"

This statement is only valid if you have "nonprofit" status in your business. You can't say, "I didn't make a profit when I sold my eggs, chickens, garden vegetables, etc" and that magically makes you "non-profit". A business has to have a federal non-profit ID# - like schools or churches do - in order to be a REAL non-profit. Don't think your lack of revenue will exempt you from this over-reaching, personal rights violating, piece of legislation.

At best, it's a poorly written bill.
At worst, the back yard ‘farmer’ could be in a world of hurt…
