I am so furious I could just bust!!!! UPDATE 3/3/10

Since the incident I have now discovered that several other drivers have also be written citations for the same exactthing! This seems like to me a intentional laid trap setup so that Louisianna can rake in a bunch of revenue! I want you guys to chime in as to how you would go about exposing this situation to try and get it fixed.
If the state of LA is going to have pre pass then the system should work! Not be turned off so it transmits no signal in-cab to give them a excuse to write innocent people $500 tickets!

The officer even noted on the ticket that there was no in cab signal any of the three times Doug passed the transponder unit

just a question is there 3 transponders?

or is this 3 difernt times that this happend...sry still drinking coffee..

One transponder but in being brought back to the scale house and being run through it he had to pass it a second and third time. No transmission was received.

What if he kept a digital camera in the truck and when he passes thru that area gets it ready to snap a pic of the thing in his truck that says by pass ?? Most cameras have a date and time setting on them. Would that help for next time ??? So sorry !! That is alot of money lost !!! Hugs and best wishes.

Would his work have records about what he was carrying? I would fight it.

I would fight the ticket. If he was given the light to bypass then he had the right to go.

I have been through the scales in LA plenty of times and my prepass never worked. Of course plenty of states do the same thing. They can turn off the transponder to make all trucks or select trucks scale. It doesn't matter if you have the prepass or not. FL, CA, NC, VA - heck just about every state I've driven in at one time or another turns off the transponder.

He may not win because it may boil down to a he said/she said thing, but I'd still make a stink with the LA DOT.

Nothing against Louisiana, I promise, all of my DHs family is from there, but if I have to drive through there, believe me, I am VERY careful! Matter of fact, on our yearly or bi-yearly trips to Tennessee, we started going through Arkansas!
