I got in a car accident today (vent).(update post 35)

So today i was leaving school. (it was our last day.) I was with my girl friend and we were going to go get ice cream. I was backing out of my spot and a girl (never seen her at school before but she is a student.) pulled out of a spot about 100 yards away. so i was backing my truck out and i was about half way out of the spot when she came speeding around me as i was still backing up and my tow hitch hit her drivers side door. My truck was fine and her car had a fairly small dent in the door. She said she wasnt going to call the police and i said that was fine with me since my truck was fine. We did exchange phone numbers however. So i got a call and her father said she went to the police station and filed a accident report. So i said she said she wasnt going to and that i wanted to settle in under the table. So now the police are involved so that means the insurance componies are involved and that will mean my insurance will go up. (which i can kinda afford) So he said he will consider handeling it under the table and now i am waiting for him to call back. the damage to her car is probably around 2-300$ish.

Don't think you can do it under the table once the police are involved. Don't accident reports get sort of broadcasted to insurance companies. Do you feel like they are trying to milk you out of money...I would be very hesitant dealing with them "under the table"
 
That is a tough one. I'm not sure they have a leg to stand on, since no report was filed at the time.
I am not sure how all that works though. I was always told to call the police at the time of the accident.
I am sure that your insurance company will find out, so you might get with them first, they will know how it all is supposed to go.
 
I used to work at a very large insurance company in claims. You don't want to handle this "under the table," that's why you have insurance. Once the info is given to your insurance company, they may find that it wasn't even your fault as far as they're concerned. Contact them immediately and let them know what happened. It's better if you call than if the other party calls first.
 
You should always call the police. If there is only a dent in the door she was not moving or not speeding around you. And if she was speeding around there would have been a long gash along that side of the car, which would be much more than $300.
 
Why should you pay for the accident if she was speeding around the corner and she clipped your hitch?????

Do not deal with under the table deal! You can bet that they can sue you again for non pay even you paid under the table. Documents, documents and documents to protect yourself!
 
My dad talked to the po;oce and aid if we could work it out under the table than we would be ok. That said that it would be cheaper under the table but that my insurance componies should be let know (which mine is) I had a police officer come ans talk to me and look at my truck ans than he went to look at the girls car and now i am waiting for his call to see who is at fault. I think that it is both of our faults. Mine because i should have looked better and hers because i was half way out of the spot backing up when she went around me.

A similar thing happened to my son except that the truck backed into him wasn't halfway out of the space - just backed up as he was going past in the parking lot. I happened to be two cars behind so I saw it. I think he was driving a bit faster than I would in a parking lot but the insurance company put the blame on the guy who backed into him (and gave us phony insurance and contact info)
