I just got busted

And sometimes, we have to tell our children no. When the first chick came home you should have explained it was against the rules and found a good home. How did you go from that to adding more, knowing it was against the rules of the HOA and the City. I believe in changing the law, but not after you broke it. You lose all credibility cause now you just want what you already have.

On another note- you signed the covenant to the HOA in order to live where you do- it is required by Federal Law. They could be telling you it is ok, until you get a new president, or a neighbor keeps complaiing. THEN you are served with a summons and sued. They don't have to tell you that is what they are going to do, they can just do it. You are violating the laws of two orginizations- both of which you agreed to. Again, I defend anyones right to have poultry and/or livestock. But do it where the law permits. If you were not happy with the laws where you chose to move, you should have moved elsewhere.

HOA covenants are not laws, they are a contractual agreement. HOAs also have rules which are not directly a part of the contract, and are much easier to change. Changing the covenants is usually VERY difficult. Changing the rules is often as easy as convincint the board and having a majority of a quorum vote in your favour. Changing the covenants generally requires a fairly high percentage (2/3rds to 3/4ths) of the entire community voting in your favour.

The ability to enfore the covenants and rules varies by state, and also by the specific community documents.

The officers of the HOA have no more or less authority than the documents and covenants grant them. Larger HOAs are usually managed by a third party hired for that purpose; managed communities are more likely to have rigidly enforced rules.

I do agree that breaking the rule and then being upset about it is inappropriate--much better to proactively work to change the rule ahead of time.

Call them Therapy chickens... Like working dogs, LOL
no, I would strike while the irons hot. Ask the president for help getting a variance. Three chickens on 1/2 acre.. give me a break..
