As I said before as hard as it may be to believe....knowing the situation out here...and my birds....it makes no sense as to how all 3 of them were hit the way they were. They have been stayin on the back 40 acres lately and I'm almost positive they didn't go across to the nieghbors today...Like I said the one was laying down in the yard the other two were up on the road aways apart from each other. I know that maybe this wasn't the drivers fault but the whole situation doesn't make sense for this area....Unfortunately there are alot of morons in this area.

ultimately you are responsible for your flock.
If something comes on our fenced pasture to kill/harm our birds, then we dispose of the predator.
If our flock escapes our pasture due to our negligence, then we are at fault.

There is no real comparison to "if it was your child" since there are laws regarding this.

Nowadays since most people do not recognize where there food comes from, do not care to learn since it is provided for them, the "in thing" agriculture environment is a big company and not someones flock that contributes to their family or community, and roadkill is a way for someone to realize the fantasies of their video game...

On our rural road we keep several big rocks. When people start to drive over the speed limit over and over these rocks magically appear on the road. They come out at night and stay for a few days until the speed limit is observed again... We do this on a regular basis.
Also we take license numbers/descriptions so we have a record if any report to the local police if needed.

You will need to be proactive in protecting your property if you want to assign blame.
 
swerving to avoid and animal on the road is a really good way to get yourself killed..I will slow down if I can without getting into trouble,,I will not swerve,I rolled my truck once after hitting a deer on ice..rolled it 3 times,walked away without a scratch thanks to seat belts..as for comparing an animal to a child,,really doesnt even deserve an answer..if my horse gets out on the road and hit by a car,,the last thing I am going to be worried about is the horse..animals are replaceable,humans are not.

As far as everything else goes. I know there was no traffic to swerve around because I was outside when it happened. We live on a straight away and the guineas will sit on the shoulder from time to time. NEVER once have we seen them just dart out into the road. And also if the animals are laying in my yard hit how is that MY fault some idiot came in to MY yard to hit them? I have seen people swerve to the shoulder at my birds...I have seen people drifting off the road here almost hitting me and my dogs walking. So unless YOU know what the situation is for sure YOU need to not pass judgement on me. As far as the rest of you thank you for caring and not being so rude.

So now you change your story to defend yourself. Thats fine. Initially, you stated

I was just told that I had some guineas hit on the road. Now this does happen...It happens along with predators when I free range them. They seem so unhappy cooped up so I free range. Anyhow I have had them hit before but not like this. Never once has there been more than one. There were 3.

Now you say you were outside when it happened, and saw no traffic. If there was no traffic, who hit them?

With as spread out as they were and where they were laying this person didn't tryin and miss them. Its not like my guineas just run out in the road either. They come out slowly so you know they are there. Not saying that its right they are in the road.

but change your story to they are now laying in your yard and someone came into your yard to hit them.

So you can twist and turn your story all you want, the bottom line is we are ultimately responsible for our animals safety. Not our neighbors, not our parents, not our friends, not people driving down the road, but we are. As I said before, if you let your animals run loose, be they dogs, cats, guineas, chickens, whatever, they will get killed on a road eventually.
