Do you have a copy of that bill of sale you wrote out? I sure hope so.

Print off copies of the e-mails and keep them in a file.
That way if he does file against you you have the proof of him writing nasty e-mails to you.
A judge won't like that.
 
no i dont but have witness my girlfriend was there and everything was signed... im not worried about it now. its over and done with. I will be curious to see if he actually does go to his lawyer....i spoke with mine and he says to keep the money and not respond
 
why not? you seem to be following this pretty closely... i just want to get as many opinions as i can. and hes OLD and im not sure he understood me correctly he just wanted to tell me what i wanted to hear is what i seemed
 
Did you ever have insurance on it? If so, it seems like the insurance co. should have caught from the VIN # that it was a different year.

I understand that you are going with the ignore him and see what happens plan, but from his end, I can understand being mad that you paid for a 2007 and ended up with a 2004. The simple, logical solution would be to research the difference in value and refund him that difference.

It's easy to say that, well, he should have noticed on the title the day he picked it up, but he would say he trusted it was the year you said it was and that it was in your possession for years and you either didn't notice or misrepresented it. If you advertised it somewhere saying it was a 2007, that's a point in his favor, because you did represent it as such in the advertisement (if you did advertise it, that is).

i never did have insurance because i dont have liscence...and of course i advertised it at a 2007 because that is what i bought the bike as! before i refund anything i want to be refunded myself, wich i payed even more then i sold this thing for. the whole thing is a nightmare
 
I think both parties have a reasonable argument. If it was sold to you as a 2007 and you are irritated about that... I'm sure you can understand the buyers opinion. He feels just as screwed as you do.

If it were me, I would apologize and explain that you had no idea it was anything but a 2004 and offer to try to repay him some of the money he is out. If you don't have it all right now- maybe he would take payments in good faith.

I just don't feel that two wrongs make a right. He was sold something that was 3 years older than he paid for. He had a responsibility to look over the paperwork thoroughly- which he did not. You made the same mistake.

Another point to consider- are you a minor? That could be in your favor. I only ask this because you state you do not have a license.
