Liable if Peafowl gets hit on Hwy?

I know in my state that if you do not withstrain your livestock you are liable if it gets in an accident on the highway but does the same law apply to peafowl?
 
Yes , also chickens ,turkeys, guinea, and DOGS!!! even if they ran off the road to keep from hitting them. Most States have fence laws, but not all..
 
How on earth will somebody prove that it is your bird though? There's no way. Dogs are different someone might say yeah I seen that litttle grey mutt dog living at his house, but with peafowl, they can be anybody's so first they'd have to prove it to make you liable. I wouldn't worry. Mine walks in the middle of the road sometimes and when a car honks he honks back its funny but he's been better about staying close to the house.
