Try playing trivia tho , what a laugh especially when its about actor/actress's. As I haven't been to the show since Tim Allen's first Santa Claus movie came out, and that must be at least, 15 yrs ago . LOL

Online friends and family pretty much keep me updated on everything else. And just right after reading about Annie Le, someone called to to tell me about the murders in Owosso over the weekend. And they were there for a charity benefit. What has this world come to? Its all very sad.

So sad that there wasn't a happy ending to Annie's disappearance.

praying for them and also praying for the missing boy by Vicki's home.

Lunch break for the kids and recess. they are throwing a inflatable globe around and saying countries around the world and listening to a geography CD. Amazing that they are learning and having fun too!

Have a good afternoon! Glad MJ is ok. It is weird not having her on here.

Hi everyone
new update regarding my hens.
Health officer called this morning regards to my written application and informed me that she has submitted my request to legal department of city and there is no response from them. Actually zoning officer earlier told me that healthofficer will not give me a permit b/c if she will than she is opening a way to others too.and she willn ot take the responsibility on her shoulders.
I mentioned to her the right to farm act.She said we dont need state laws.We GO BY OUR CITY ORDINANCES.
I postedmy problem on a legalforum(user name as sajju) http://forum.freeadvice.com/other-government-administrative-law-matters-103/chickens-hens-allowed-city-484125.html

one
of hte respond there is that it is for commercial use
and second they mentioned the following information
"Michigan Commission of Agriculture

Generally Accepted Agricultural and Management Practices for Site Selection and Odor Control for New and Expanding Livestock Production Facilities

Category 3 Sites: Sites generally not appropriate for new and expanding livestock
production facilities.

3. Residential zones - Areas zoned primarily for residential use will generally
have housing at a density that necessitates setback distances for livestock
production facilities to prevent conflicts. New livestock production facilities
shall not be constructed within 1,500 feet of areas zoned for residential use
where agriculture uses are excluded. Existing livestock production facilities
may be expanded within 1,500 feet of areas zoned for residential use with
approval from the local unit of government."

ANYONE HAS ANY SUGGESTIONS FOR ME?

Soomi,

Your health officer is wrong, the Right to Farm Act supersedes all local laws, period. I know someone posted the link to a thread on it earlier, but not sure if it was this one or not. https://www.backyardchickens.com/forum/viewtopic.php?id=182280&p=6 I know there has been more than one discussion on it. This one talks about how it was taken all the way to the supreme court and won and you only have to have the intent to sell something, such as eggs, you don't have to actually sell anything. There are other references in there, check them out. I hope they help. That must be so frustrating!

It is my understanding that State laws trump city ordinances, butI may be mistaken. I dont think a city ordinance can limit a right you may have as a citizen of the state.

Sorry I dont have any advice.

:(FYI: Bummed...I heard this morning from my source(s) that TSC will no longer be carrying the Dumor line of poultry feeds by the end of the yr. I am unaware of the fate of the other Dumor livestock feeds. Alternatively I was told they will carry Purina feeds...what formulas I don't know...Dumor is milled by Purina for TSC.

One more suggestion on that legal forum is following:

Stevef;2357755 :

The "Right to Farm Act" won't help you. Even if you try a limited commercial venture, you'll fail on the site selection part.

It looks like you need to go back to the health department and try to get that permit.

I have only today and tomorrow in my hand.Dont know what to do.Even if I try going back to the health officer and asking her to consider right to farm act and grant me permit. There is v.v.v.very little hope.

My husband gets frustrated with me for not watching the news because I don't know what's going on in the world.

Soomi, I sure hope you're able to keep your hens. I'm keeping my fingers crossed for you!

Anybody know if owls will go after ducks?
